4.15 As regards the author's claim under article 26, the State party argues that it is inadmissible ratione temporis.

4.3 As regards the author's claim under article 10 of the Covenant, that he did not receive proper medical treatment during his detention, the State party notes that this allegedly occurred before 8 March 1990, and that the claim is therefore inadmissible ratione temporis.

9.10 As regards the author's claim under article 14, paragraph 5, the Committee notes that the author's appeal with regard to both conviction and sentence was in fact heard and the evidence reviewed by the Court of Appeal.

As regards the author's claim that the police fabricated the evidence against him, the State party notes that this allegation was brought before the courts and that it was rejected; there is no suggestion that this rejection was based on racial discrimination.

6.3 As regards the author's claim that he did not have a fair hearing, once the Federal Trial Court Division rejected the author's application for leave to appeal which was based, inter alia, on allegations of bias, no further domestic remedies were available.

9.2 As regards the author's claim under article 15, the Committee is called upon to determine whether the conviction of the author for homicide and attempted homicide by the German courts amounts to a violation of that article.

5.4 As regards the author's claim that the imposition of the death sentence was disproportionate since no one was killed or wounded during the robbery, the State party submits that the author's conviction was in accordance with Zambian law.

7.4 As regards the author's claim that he was heavily beaten and tortured upon arrest, the Committee notes that that allegation was before the judge who rejected it on the basis of the evidence.
٧-٤ وفيما يتعلق بادعاء صاحب البلاغ بأنه ضرب ضربا مبرحا وعُذب لدى توقيفه، تلاحظ اللجنة أن ذلك الادعاء عُرض على القاضي الذي رفضه استنادا إلى اﻷدلة.

6.6 As regards the author's claim concerning his legal representation at the appeal proceedings, the Committee noted that the author's lawyer was provided by the Jamaica Council for Human Rights, a non-governmental organization.
٦-٦ وفيما يتعلق بادعاء صاحب البلاغ الخاص بتمثيله القانوني في إجراءات الاستئناف فإن اللجنة تلاحظ أن محامي صاحب البلاغ قدمه المجلس الجامايكي لحقوق اﻹنسان، وهو منظمة غير حكومية.

8.6 As regards the author's claim that he should not have been convicted on the basis of the evidence against him, the State party submits that that is a matter for the court of first instance to decide.
٨-٦ وفيما يتعلق بادعاء صاحب البلاغ بأن اﻷدلة الموجهة ضده لا تدينه، تدفع الدولة الطرف بأن هذه مسألة تقررها المحكمة الابتدائية.

4.2 As regards the author's claim under article 9 of the Covenant, the Committee notes that the author was arrested and detained upon a charge for murder and that he was consequently convicted and sentenced to imprisonment in accordance with Canadian law.

6.6 As regards the author's claim about the failure to provide him with the services of an interpreter, the Committee notes that this issue was never brought to the attention of the courts, neither during the trial, nor at appeal.
٦-٦ وفيما يتعلق بادعاء صاحب البلاغ بصدد عدم تزويده بخدمات مترجم شفهي، تلاحظ اللجنة أن هذه المسألة لم تعرض على المحاكم، لا أثناء المحاكمة ولا في الاستئناف.

4.5 As regards the author's claim under articles 17 and 18 of the Covenant, the Committee considers that the author has failed to substantiate, for purposes of admissibility, that his rights under these articles were violated.

As regards the author's claim under article 19 of the Covenant, the Committee notes that he invoked " the right of political and social criticism and of the freedom of the press " on appeal.

4.4 As regards the author's claim that his right to review of conviction and sentence was violated, the State party argues that he has failed to substantiate this claim and that, moreover, his claim is incompatible with the provision of article 14, paragraph 5.
٤-٤ وفيما يتعلق بادعاء صاحب البلاغ بأنه وقع انتهاك لحقه في أن يعاد النظر في حكمي اﻹدانة والعقوبة، ترد الدولة الطرف بأن صاحب البلاغ لم يقدم الدليل الكافي على ادعائه هذا، فضلا عن أن ادعاءه لا يتماشى مع أحكام الفقرة ٥ من المادة ٤١.

8.4 As regards the author's claim that he did not have enough time for the preparation of his defence, the State party notes that a lawyer was appointed for the author on 20 August 1988 and that the request sheets show that the author asked for a meeting with the lawyer on 30 September and 13 October 1988, whereupon the lawyer was informed.
٨-٤ وفيما يتعلق بادعاء صاحب البلاغ بأنه لم يكن لديه الوقت الكافي لﻹعداد لدفاعه، تشير الدولة الطرف إلى أنه تم تعيين محام لصاحب البلاغ في ٢٠ آب/أغسطس ١٩٨٨ وأن أوراق الطلبات تظهر أن صاحب البلاغ طلب الاجتماع بمحاميه في ٣٠ أيلول/سبتمبر وفي ١٣ تشرين اﻷول/أكتوبر ١٩٨٨، ومن ثم تم إبلاغ المحامي.

11.5 As regards the author's claim under article 14 of the Covenant, the Committee notes that a lawyer was appointed for the author on 20 August 1988, that the author requested to meet his lawyer, that the State party submits that it did forward the author's requests to the lawyer, and that the author states that he did not meet his lawyer.

8.2 As regards the author's claim that he was beaten in order to make him sign a confession, the Committee notes that this claim was put before the judge and the jury at trial, who rejected it.
٨-٢ وفيما يتعلق بادعاء الشاكي بأنه ضرب ﻹجباره على توقيع اعتراف، تلاحظ اللجنة أن ادعاءه عرض على القاضي والمحلفين في المحاكمة، ورفضوه.

6.7 As regards the author's claim under article 2, paragraphs 3 (a) and (b), read in conjunction with article 14, paragraph1, the Committee takes note of his allegations that the decision of the Supreme Court of Justice that rejected the author's appeal constituted a violation of the right to an effective remedy.
6-7 أما عن شكوى صاحب البلاغ في إطار الفقرة 3(أ) و(ب) من المادة 2 من العهد، عند قراءتها بالاقتران بالفقرة 1 من المادة 14 منه، فتحيط اللجنة علماً بادعاء صاحب البلاغ أن قرار المحكمة القضائية العليا رفض سبيل الانتصاف الذي قدمه يشكل انتهاكاً للحق في سبيل انتصاف فعال.
