2. No migrant worker or member of his or her family shall be deprived of his or her authorization of residence or work permit or expelled merely on the ground of failure to fulfil an obligation arising out of a work contract unless fulfilment of that obligation constitutes a condition for such authorization or permit.
2- لا يجوز حرمان العامل المهاجر أو أي فرد من أفراد أسرته من إذن الإقامة أو تصريح العمل أو طرده لمجرد عدم وفائه بالتزام ناشئ عن عقد عمل إلا إذا كان الوفاء بذلك الالتزام يشكل شرطاً لذلك الإذن أو التصريح.

3. In order to allow migrant workers referred to in paragraph 2 of the present article sufficient time to find alternative remunerated activities, the authorization of residence shall not be withdrawn at least for a period corresponding to that during which they may be entitled to unemployment benefits.
3- لإعطاء العمال المهاجرين المشار إليهم في الفقرة 2 من هذه المادة وقتاً كافياً لإيجاد أنشطة بديلة يزاولونها مقابل أجر، لا يسحب إذن الإقامة لفترة لا تقل عن الفترة التي قد يستحقون خلالها استحقاقات بطالة.

The Committee recommends that the State party modify its legislation so that migrant workers shall not be regarded as in an irregular situation nor shall they lose their authorization of residence by the mere fact of termination of their employment prior to the expiration of their work permit, in accordance with article 51 of the Convention.
35- توصي اللجنة الدولة الطرف بتعديل تشريعاتها حتى لا يُعتبر العمال المهاجرون الذين تُنهى عقود عملهم قبل تاريخ انتهاء رخصة العمل كما لو كانوا في وضع غير قانوني، وحتى لا يفقدوا رخصة الإقامة بمجرد حدوث ذلك، وذلك طبقاً للمادة 51 من الاتفاقية.

(35) The Committee recommends that the State party modify its legislation so that migrant workers shall not be regarded as in an irregular situation nor shall they lose their authorization of residence by the mere fact of termination of their employment prior to the expiration of their work permit, in accordance with article 51 of the Convention.
(35) توصي اللجنة الدولة الطرف بتعديل تشريعاتها حتى لا يُعتبر العمال المهاجرون الذين تُنهى عقود عملهم قبل تاريخ انتهاء رخصة العمل كما لو كانوا في وضع غير قانوني، وحتى لا يفقدوا رخصة الإقامة بمجرد حدوث ذلك، وذلك طبقاً للمادة 51 من الاتفاقية.

The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families further prohibits the expulsion of migrant workers who are documented or in a regular situation in order to deprive them or their family of the rights arising out of their authorization of residence or work permit.
801 - وتحظر كذلك الاتفاقية الدولية لحماية حقوق جميع العمال المهاجرين وأفراد أسرهمطرد العمال المهاجرين الحائزين للوثائق اللازمة أو الذين في وضع قانوني بهدف حرمانهم أو حرمان أفراد أسرهم من الحقوق الناشئة عن الإذن بالإقامة أو تصريح العمل.
