GENCON's claim for loss of profits relates partly to loss of profits on the five back-to-back contracts discussed above and partly to loss of profits on those future back-to-back contracts that GENCON contends it would have undertaken had its insolvency and the failure of its bunker supply not forced it out of the bunker trade.
140- ومطالبة " جينكون " بتعويض الكسب الفائت تتعلق جزئياً بالكسب الفائت من العقود المتبادلة الخمسة المذكورة أعلاه، وجزئياً، بالكسب الفائت من العقود المتبادلة المقبلة التي تؤكد " جينكون " أنها كانت ستبرمها لو لم يجبرها إعسارها وعدم تزويدها بالوقود على ترك تجارة الوقود.

In addition to the profits that GENCON claims it would have earned on agent's fees charged for these five back-to-back contracts, GENCON contends that it could have earned an additional USD 7,382,412 in profits on unspecified back-to-back contracts that it states it would have arranged in the five-year period following the liberation of Kuwait from 2 March 1991 to 2 March 1996.
143- وعلاوة على الأرباح التي تزعم " جينكون " أنها كانت ستحصل عليها من أتعاب الوكيل في هذه العقود المتبادلة الخمسة، تؤكد أنها كانت ستكسب مبلغ 412 382 7 دولاراً إضافياً في تنفيذ عقود متبادلة غير محددة تقول إنها كانت ستبرمها في فترة السنين الخمس التي أعقبت تحرير الكويت، من 2 آذار/مارس 1991 إلى 2 آذار/مارس 1996.

As stated above, GENCON argues that, because of its inability to pay the penalties and contractual damages claimed against it by its two refinery suppliers, SAMAREC and SITCO (relating to the five back-to-back contracts in 1991), it has been blacklisted by all Saudi Arabian refiners.
144- وكما هو مذكور أعلاه، تؤكد " جينكون " أنها وضعت في القائمة السوداء من قبل جميع مؤسسات التكرير السعودية، بسبب عجزها عن تسديد الغرامات وقيمة الأضرار التعاقدية التي يطالب بها كل من مورديها " ساماريك " و " سيتكو " (بشأن العقود المتبادلة الخمسة في 1991).
