The Committee is also concerned that this right is also subject to misinterpretation, notably as regards guardianship, and disregarded in the case of bidoon children and in judicial proceedings where parents are involved, and especially when sentencing parents to death.

27. The Committee notes as positive the establishment in 2010 of the Central System to Resolve Illegal Resident Status, the issuance of birth certificates for some bidoon children and the assurances given by the delegation that the situation of bidoon families will be resolved in the next five years.
27- تلاحظ اللجنة أن من الأشياء الإيجابية التي تمت إنشاء الجهاز المركزي لتسوية أوضاع المقيمين بصورة غير قانونية، وإصدار شهادات ميلاد لبعض أطفال البدون والتأكيدات التي قدمها الوفد بأن وضع أسر البدون سيُحلّ في السنوات الخمس المقبلة.

28. The Committee urges the State party to shift from its humanitarian approach to a child rights-based response to the situation of bidoon children and to take immediate measures to ensure that all bidoon children enjoy all their rights enshrined in the Convention without discrimination.
28- تحث اللجنة الدولة الطرف على التحول من اتباع نهجها الإنساني إلى الاستجابة لحالة أطفال البدون على أساس حقوق الطفل، واتخاذ تدابير فورية لضمان تمتع جميع أطفال البدون بجميع الحقوق المنصوص عليها في الاتفاقية دون تمييز.

(a) Adopt urgent measures to address the situation of bidoon children with disabilities in terms of their right to have access to suitable health care, education and rehabilitation services depending on their particular disability;
(أ) اعتماد تدابير عاجلة للتصدي لوضع أطفال البدون ذوي الإعاقة من حيث حقهم في الحصول على خدمات الرعاية الصحية والتعليم وإعادة التأهيل المناسبة، توقفاً على الإعاقة الخاصة بكل منهم؛

(a) Take immediate measures to put an end to the segregation between Kuwaiti and bidoon children in schools and ensure that the latter have full access to public schools without discrimination.
(أ) اتخاذ تدابير فورية لوضع حد للتفرقة بين الأطفال الكويتيين وأطفال البدون في المدارس، وضمان تمتع أطفال البدون بفرص الوصول الكاملة إلى المدارس العامة دون تمييز.

Until all bidoon children are included in the public school system, the State party should take interim measures to ensure that bidoon children have effective access to private schools for the school year 2013/14 without any fee being requested from their families;
وإلى حين دخول جميع أطفال البدون في نظام المدارس العامة، ينبغي للدولة الطرف اتخاذ تدابير مؤقتة لضمان تمتع أطفال البدون بسبل الالتحاق الفعالة بالمدارس الخاصة للعام الدراسي 2013-2014 دون فرض أية رسوم على أهلهم؛

71. The Committee urges the State party to address the root causes of poverty and of the economic exploitation of bidoon children and ensure that families living in poverty receive financial support and free and accessible services and that their children do not drop out of school.
71- تحث اللجنة الدولة الطرف على التصدي للأسباب الجذرية في فقر أطفال البدون واستغلالهم اقتصادياً وضمان حصول الأسر التي تعاني من الفقر على الدعم المالي والخدمات المجانية الميسورة وعدم تسرب أطفالهم من المدارس.

58. In the light of its general comment No. 15 (2013) on the right of the child to the enjoyment of the highest attainable standard of health, the Committee urges the State party to take immediate measures to ensure that all bidoon children receive without delay all medical care and treatment required by their health condition.
58- تحث اللجنة الدولة الطرف، في ضوء تعليقها العام رقم 15(2013) بشأن حق الطفل في التمتع بأعلى مستوى صحي يمكن بلوغه، على اتخاذ تدابير فورية لضمان حصول جميع أطفال البدون على الرعاية الطبية والعلاج اللازم لحالتهم الصحية دون تأخير.

However, she regrets that the regularization process has been slow and incomplete and encourages the Government to accelerate this process to ensure that bidoon children have full access to social services (education, health, etc.) and protection from all forms of exploitation, neglect or violence.
غير أنها تعرب عن أسفها لأن عملية تصحيح أوضاع هؤلاء الأطفال تتسم بالبطء وعدم الاكتمال، وتشجع المقررة الخاصة الحكومة على تسريع وتيرة هذه العملية لضمان حصول أطفال البدون على جميع الخدمات الاجتماعية (التعليم والصحة وما إلى ذلك) وحمايتهم من جميع أشكال الاستغلال أو الإهمال أو العنف.
