1. The operator should, taking into account the availability of financial guarantees, be encouraged or required to cover liability under guideline 5, paragraph 1, for amounts not less than the minimum specified by law for the type of activity dangerous to the environment concerned and should continue to cover such liability, during the period of the time limit of liability, by way of insurance, bonds or other financial guarantees.

2. With regard to the liability of the notifier, or exporter under Article 4, paragraph 1, or of the importer under Article 4, paragraph 2, insurance, bonds or other financial guarantees referred to in paragraph 1 of this Article shall only be drawn upon in order to provide compensation for damage covered by Article 2 of the Protocol.

(4) Paragraph 3 provides that the measures provided by the State of origin should include the requirement that the operator or, where appropriate other person or entity, establish and maintain financial security such as insurance, bonds or other financial guarantees to cover claims of compensation.

In response to decision OEWG-IV/7, adopted by the Open-ended Working Group at its fourth session, the Secretariat prepared a note on the options which may be available with respect to the requirement of insurance, bonds or other financial guarantees under article 14 of the Basel Protocol on Liability and Compensation.

2. Calls upon Parties to continue to consult at the national and regional levels with a view to determining possible means to overcome perceived obstacles to ratification of the Protocol, including in respect of the requirement for insurance, bonds or other financial guarantees under article 14 of the Protocol.

2. By its decision OEWG-IV/7, the Open-ended Working Group at its fourth session requested " the Secretariat to report to the Open-ended Working Group at its fifth session on the options that may be available with respect to the requirement of insurance, bonds or other financial guarantees and the financial limits established under the Protocol resulting from its consultations with relevant institutions " .
10- طلب الفريق العامل مفتوح العضوية في دورته الرابعة في مقرره - 4/7 إلى الأمانة أن : " تقدم تقريرا إلى الفريق العامل مفتوح العضوية في دورته الخامسة عن الخيارات التي قد تكون متاحة بشأن اشتراط التأمين أو السندات أو الضمانات المالية الأخرى والقيود المالية المنشأة بموجب البروتوكول والناتجة عن مشاوراتها مع المؤسسات الوثيقة الصلة. Pursuant to the decision, the Secretariat reviewed comments on obstacles to ratification of the Protocol relating to insurance, bonds or other financial guarantees and the financial limits established under the Protocol made by participants at the regional workshops on the Protocol held in Central America, South America, English-speaking Africa and Central and Eastern Europe.

Basel Protocol on Liability and Compensation: insurance, bonds or other financial guarantees

The States concerned shall take the necessary measures to ensure that the operator establishes and maintains financial security such as insurance, bonds or other financial guarantees to cover claims of compensation.
