B. Communication No. 1303/2004, Chiti v. Zambia

In the absence of rebuttal from the State party, the Committee concluded that the State party had failed to protect the life of Mr. Chiti, in violation of article 6 of the Covenant.
وفي ظل عدم تفنيد الادعاء من جانب الدولة الطرف، خلصت اللجنة إلى أن الدولة الطرف أخفقت في حماية حياة السيد تشيتي بما ينتهك المادة 6 من العهد.

2.2 As a consequence of the torture inflicted, Mr. Chiti was transferred to Maina Soko Military hospital in Lusaka where it appeared that his eardrum had been perforated.
2-2 ونتيجة لما تعرض له السيد تشيتي من تعذيب، نُقل إلى مستشفى ماينا سوكو في لوساكا حيث تبين أن طبلة أذنه ثُقبت.

2.7 In the meantime, in 1998, the Legal Resources Foundation sued the State party on behalf of Jack Chiti.

The court found in his favour and ruled that Mr. Chiti, the author and their children be awarded compensation for the illegal eviction from their home and loss and damage of personal effects as well as compensation to Mr. Jack Chiti for the torture suffered.

2.9 Mr. Chiti's trial suffered unnecessary delays with hearings being often postponed.
2-9 وقد تأخرت محاكمة السيد تشيتي دون مبرر، حيث أُجلت الجلسات في أحيان كثيرة.

The State party argues that after the submission of the initial communication, Jack Chiti passed away and the matter raised in the communication is still pending before national courts.
وتحتج الدولة الطرف بأن السيد جاك تشيتي تُوفي بعد تقديم الرسالة الأولى وبأن المسألة التي يثيرها البلاغ لا تزال قيد النظر أمام المحاكم الوطنية.

5.2 The author submits a newspaper article stating that Mr. Chiti was released from prison on 21 June 2004 for medical reasons as he was suffering from cancer which confined him to a wheelchair.
5-2 وتقدم صاحبة البلاغ مقالة صحفية تفيد بأن السيد تشيتي أُفرج عنه من السجن يوم 21 حزيران/يونيه 2004 لأسباب طبية، حيث كان يعاني من السرطان الذي أقعده على كرسي متحرك.

As a result, the court ruled that Mr. Chiti, the author and their children be awarded compensation for the illegal evictions from their home and loss and damage of personal effects as well as compensation to Mr. Jack Chiti for the torture suffered.
ونتيجة لذلك، حكمت المحكمة بدفع تعويض إلى السيد تشيتي وصاحبة البلاغ وأبنائهما بسبب طردهم على نحو غير قانوني من منزلهم وما لحق بممتلكاتهم الشخصية من خسائر وأضرار، وكذلك بدفع تعويض للسيد جاك تشيتي لما تعرض له من تعذيب.

With regard to the author's allegation that Mr. Chiti's trial suffered undue delay, the Committee notes that the information provided is very general and does not contain indications as to the circumstances under which the trial took place.
وفيما يتعلق بادعاء صاحبة البلاغ أن محاكمة السيد تشيتي تأخرت دون مبرر، تلاحظ اللجنة أن المعلومات المقدمة ذات طبيعة عامة جداً ولا تتضمن إشارات إلى الظروف التي أُجريت فيها المحاكمة.

The Committee also notes that Mr. Chiti was HIV-positive and that he was allegedly detained in inhuman conditions, denied adequate food and a clean environment.
وتلاحظ اللجنة أيضاً أن السيد تشيتي كان مصاباً بفيروس نقص المناعة البشري وأنه احتُجز، وفقاً للادعاءات، في أوضاع غير إنسانية وحُرم من الغذاء الكافي والبيئة النظيفة.

The Committee notes in this regard that according to the author, these inhuman conditions of detention led to Mr. Chiti's premature death.
وتلاحظ اللجنة، في هذا الصدد، ادعاءات صاحبة البلاغ أن الأوضاع غير الإنسانية لاحتجاز السيد تشيتي هي التي أدت إلى وفاته المبكرة.

Since 1994, Mr. Chiti has been Professor (full Chair) of Administrative Law at the University of Firenze, Italy, where he is also President of the Specialized Course on European Studies and Jean Monnet Professor of European administrative law with European Chair ad personam.
