One of the fundamentals of the right to due process for everyone charged with a criminal offence is to “examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him”. (Covenant on Civil and Political Rights, art. 14,3 (e)).

12. Subparagraph 3 (e) states that the accused shall be entitled to examine or have examined the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him.

(e) Accused persons have the right to examine the witnesses against them and to obtain the attendance and examination of witnesses on their behalf under the same conditions as witnesses against them.

This situation allegedly amounted to a violation of the authors' rights under article 14, paragraph 3(e), to obtain witnesses under the same conditions as witnesses against them.

25. Finally, Saddam Hussein did not enjoy the possibility " to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him " , as required by article 14 (3) (e) of the Covenant.
