On the one hand, government is sovereign, with governmental sovereignty being derived from popular sovereignty, which the citizens give to government, within constitutional limits, in the interest of security and the public good.

19. According to article 83 of the Constitution, El Salvador is a sovereign State whose capacity to govern is vested in the people, which exercises this capacity in the prescribed manner and within the constitutional limits.

CERD also noted with concern the vague and general statement that it will not accept obligations going beyond constitutional limits or the obligation to introduce a judicial process beyond those prescribed under the Constitution, and encouraged the Bahamas to consider withdrawing all the reservations it entered upon acceding to the Convention.
وأحاطت هذه اللجنة علماً أيضاً مع القلق بالبيان المبهم والعام الذي جاء فيه أن الدولة الطرف لن تقبل الالتزامات التي تتعدى الحدود الدستورية أو الالتزام باتخاذ إجراءات قضائية تتجاوز تلك المنصوص عليها في الدستور، وشجعت جزر البهاما على النظر في سحب جميع التحفظات التي أبدتها عند انضمامها إلى الاتفاقية(10).

6. The Committee expresses concern at the broad and vague reservation to the Convention that still remains in place and which, inter alia, states that " ratification of the Convention by Jamaica does not imply the acceptance of obligations going beyond the constitutional limits nor the acceptance of any obligation to introduce judicial processes beyond those prescribed under the Constitution " (arts. 2 and 6).

Mr. KIM (United States of America), referring to question 17 of the list of issues, said that since the United States had submitted a reservation to the Covenant permitting the imposition of capital punishment within United States constitutional limits, the scope of conduct subject to the death penalty was not relevant to United States obligations under the Covenant.
