٣-٣ بالرغم من انتهاء هذا العقد وفقا للبند ٣-١ منه، فإذا طلب المتعاقد عقد استكشاف، قبل تسعين يوما على اﻷقل من تاريخ انتهاء العقد، فإن حقوق المتعاقد والتزاماته بموجب هذا العقد تستمر إلى أن ينظر في الطلب ويتم إصدار عقد الاستكشاف أو رفضه.

Section 1031 of the 1998 German Arbitration Law deems compliance with the writing requirement “if the arbitration agreement is contained in a document, transmitted from one party to the other party or by a third party to both parties and—if no objection was raised in good time—the contents of such document are considered to be part of the contract in accordance with common usage”.

In that event, the Executive Director of OIP, in consultation with the Executive Chairman of UNMOVIC, will appoint experts to reconsider the contract in accordance with the procedures set out above.
