The Governing Council considered Kuwait's submission and recognized that, given the extended period of time during which the Tripartite Commission was unsuccessful in its attempts to obtain information from the former Iraqi regime concerning the fate of the detainees, the families of the deceased detainees had suffered a different and ongoing form of MPA that was not anticipated by decision 8.
وقد نظر مجلس الإدارة في رسالة الكويت وأقر بأن أسر المحتجزين المتوفين عانت آلاماً وكروباً ذهنية متواصلة ومن شكل آخر يختلف عما توقعه المقرر رقم 8، نظراً إلى طول المدة التي لم تفلح خلالها اللجنة الثلاثية في محاولاتها للحصول على معلومات من النظام العراقي السابق بشأن مصير المحتجزين.

The Governing Council determined that, as a large number of family members of deceased detainees had filed their claims for personal losses during the Commission's regular filing period, claims for personal losses of other family members should not be accepted for late filing as part of the programme established for the deceased detainee claims.
ونظراً لكون عدد كبير من أفراد أسر المحتجزين المتوفين سبق لهم أن قدموا مطالبات بالتعويض عن خسائر شخصية خلال الفترة العادية التي حددتها اللجنة لتقديم المطالبات، قرر المجلس عدم قبول مطالبات أفراد أسر أخرى بالتعويض عن الخسائر الشخصية بصفتها طلبات متأخرة ضمن البرنامج المعد لمطالبات المحتجزين المتوفين.

Consequently, the Panel determines that it is appropriate to deduct the amount paid by the National Committee, set out in paragraph 72 above, to the families of those 569 deceased detainees from the loss of support awards proposed by the Panel in respect of those families.
