1.2 On 18 August 2007, the Special Rapporteur on New Communications and Interim Measures, acting under rule 108, paragraph 1, of the Committee's rules of procedure, requested the State party not to deport the complainant to the Democratic Republic of the Congo while her complaint was being considered.

1.2 On 31 July 2009, under rule 114 (former rule 108) of its rules of procedure (CAT/C/3/Rev.5), the Committee requested the State party not to deport the complainant to Ethiopia while her complaint was under consideration by the Committee.

8.2 To justify its refusal to comply with the Committee's decision requesting it not to deport the complainant to Tunisia while his case was being considered by the Committee, the State party puts forward four arguments:
