27. The meaning of the second sentence of paragraph 2E of the dispositif, and thus what the two sentences of paragraph 2E of the dispositif mean when taken together, is unclear.

It evidences a measure of uncertainty in a case in which the tension between State practice and legal principle is unparalleled. It concludes, in Paragraph 2E of the dispositif, that,

35. For all of these reasons, I am unable to see why the Court resorts to the answer it does in the second part of paragraph 2E of the dispositif.

20. My vote in favour of subparagraph (2) of the dispositif has thus been made with considerable hesitation.

21. The way subparagraph (3) (A) of the dispositif is formulated does not separate out the various grounds that the Court relied on in reaching its conclusions.

My negative votes with regard to the remaining items of the dispositif should not be seen as reflecting my view that the construction of the wall by Israel on the Occupied Palestinian Territory does not raise serious questions as a matter of international law.

However, I find myself obliged to explain the reasons which have led me to vote in favour of paragraph 2E of the dispositif, which carries the implication of the indecisiveness of the Court and indirectly admits the existence of a " grey area " in the present regulation of the matter.
