Article 6 on specific exclusions: It is not understood why chartered vessels, particularly those chartered from the carrier itself, are excluded from the application of this convention.

There is no justification for excluding chartered ships from the application of this convention, especially if they have been chartered from the carrier itself.

It was suggested that, for example, consistent with international sales law, if the consignee sampled the goods it would have exercised rights under the contract of carriage, and would have the obligation to accept delivery from the carrier.

(b) An electronic record shall be authenticated by the electronic signature of the carrier or a person having authority from the carrier.
(ب) يوثَّق السجل الالكتروني بالتوقيع الالكتروني للناقل أو لشخص مأذون له من الناقل.

If pursuant to article 2.1 the carrier and the shipper have agreed to the use of an electronic record, the shipper is entitled to obtain from the carrier a negotiable electronic record unless they have agreed not to use a negotiable electronic record or it is the custom, usage or practice in the trade not to use one.
واذا كان الناقل والشاحن قد اتفقا، عملا بالمادة 2-1، على استخدام سجل الكتروني، كان من حق الشاحن أن يحصل من الناقل على سجل الكتروني قابل للتداول، الا اذا كانا قد اتفقا على عدم استخدام سجل الكتروني قابل للتداول أو كانت العادة أو العرف أو الممارسة المتبعة في المهنة تقضي بعدم استخدام سجل من هذا القبيل.

(i) Without prejudice to the provisions of article 10.1 the holder of a negotiable transport document is entitled to claim delivery of the goods from the carrier after they have arrived at the place of destination, in which event the carrier shall deliver the goods at the time and location mentioned in article 4.1.3 to such holder upon surrender of the negotiable transport document.

(b) If the holder does not claim delivery of the goods from the carrier after their arrival at the place of destination, the carrier shall advise accordingly the controlling party or, if, after reasonable effort, it is unable to identify or find the controlling party, the shipper.
(ب) إذا لم يطالب الحائز بتسلم البضاعة من الناقل بعد وصولها إلى مكان المقصد، يقوم الناقل بإبلاغ الطرف المسيطر بذلك، أو بإبلاغ الشاحن إذا لم يتمكن بعد بذل جهد معقول من التعرف على الطرف المسيطر أو العثور عليه.

(a) The holder of the negotiable transport document or negotiable electronic transport record is entitled to claim delivery of the goods from the carrier after they have arrived at the place of destination, in which event the carrier shall deliver the goods at the time and location referred to in article 43 to the holder:

The progress in information and communication technology, which was illustrated by the advanced cargo tracking system that many carriers had offered via the Internet in recent years, made it much easier for cargo interests to obtain details about the delivery of goods directly from the carrier, than it was in the time when consignees needed to rely essentially on the transport document itself for that information.
ومن شأن التقدّم في تكنولوجيا المعلومات والاتصالات، الذي يتجلى في النظام المتقدّم لتعقب البضائع المشحونة الذي أخذ يوفّره كثير من الناقلين بواسطة الإنترنت في السنوات الأخيرة، يجعل حصول الأطراف ذات المصلحة في البضاعة، من الناقل مباشرة، على تفاصيل عن تسليم البضاعة أسهل بكثير مما كان عليه الأمر عندما كان يضطر المرسل إليه إلى الاعتماد أساسا على مستند النقل ذاته للحصول على تلك المعلومات.

" (a) The holder of the negotiable transport document or negotiable electronic transport record is entitled to claim delivery of the goods from the carrier after they have arrived at the place of destination, in which event the carrier shall deliver the goods at the time and location referred to in article 45 to the holder:

(c) If the name or the address of the consignee is not known to the carrier or if the consignee, after having received a notice of arrival, does not claim delivery of the goods from the carrier after their arrival at the place of destination, the carrier shall so advise the controlling party, and the controlling party shall give instructions in respect of the delivery of the goods.
(ج) إذا لم يكن اسم المرسل إليه أو عنوانه معروفا لدى الناقل، أو إذا لم يطالب المرسل إليه، بعد تلقيه إخطارا بالوصول، بتسلّم البضاعة من الناقل بعد وصولها إلى مكان المقصد، وجب على الناقل أن يبلغ الطرف المسيطر بذلك، ووجب على الطرف المسيطر أن يصدر تعليمات بشأن تسليم البضاعة.
