Regarding the progressive commissioning of the International Data Centre, and the design and development of a global communications infrastructure, significant progress has been made with the support of the technical experts from Working Group B and of the staff of the prototype International Data Centre in Arlington, Virginia.

The Commission was also informed that the Secretariat had facilitated consultations between experts from Working Group III (Transport Law) and experts from Working Group II (Arbitration and Conciliation) and that a common understanding had been reached that accommodated the needs and general approach of both working groups regarding the provisions on arbitration in the draft Convention.

The Commission was also informed that the Secretariat had facilitated the initiation of consultations that were currently under way between experts from Working Group III (Transport Law) and experts from Working Group II (Arbitration and Conciliation) with the hope that an agreement could be found on the provisions in the draft convention relating to arbitration.

This assessment should involve experts from Working Group III (Transportation) in view of the provisions related to electronic documents contained in the recent United Nations Convention on Contracts for the International Carriage of Goods Wholly or Partly by Sea to be known as the " Rotterdam Rules " .

The Commission noted that the topic of arbitrability of insolvency issues and the use of other alternative dispute resolution processes (such as mediation and facilitation) in the context of insolvency had been discussed as a possible topic for future work which would be undertaken by Working Group II (Arbitration and Conciliation), with input from Working Group V (Insolvency Law) (see paras. 183 and 185-187 above).
210- ولاحظت اللجنة أن موضوع قابلية مسائل الإعسار للتحكيم واستخدام إجراءات أخرى بديلة لتسوية النـزاعات (مثل الوساطة والتيسير) في سياق الإعسار كان قد نوقش كموضوع محتمل لعمل يضطلع به مستقبلا الفريق العامل الثاني (المعني بالتحكيم والتوفيق) بمساهمة من الفريق العامل الخامس (المعني بقانون الإعسار) (انظر الفقرات 183 و185 إلى 187).
