The Committee recommends that the State party strengthen its efforts to ensure that the general principle of the best interests of the child is understood, appropriately integrated and implemented in all legal provisions as well as in judicial and administrative decisions, and in projects, programmes and services that have direct and indirect impact on children.

As regards the general principle of the best interests of the child under article 3 of the Convention, the Committee is concerned that this principle is not given adequate attention in national legislation and policies and that this principle is not a primary consideration in decisionmaking regarding children, for example custody decisions.
136- في ما يخص المبدأ العام المتعلق بمصالح الطفل الفضلى المنصوص عليه في المادة 3 من الاتفاقية، يساور اللجنة القلق لعدم منح هذا المبدأ الاهتمام الكافي في التشريعات والسياسات الوطنية ولأن هذا المبدأ لا يوضع في المقام الأول عند اتخاذ القرارات المتعلقة بالأطفال، مثل القرارات الخاصة بالحضانة.

The Committee further recommends that the State party continue and strengthen its efforts to ensure that the general principle of the best interests of the child is appropriately integrated in all legal provisions as well as in judicial and administrative decisions and in projects, programmes, and services that have an impact on children.
كما توصي اللجنة الدولة الطرف بأن تواصل وتعزز جهودها لضمان إدراج المبدأ العام المتعلق بمصالح الطفل الفضلى على نحو مناسب في جميع الأحكام القانونية وكذلك في القرارات القضائية والإدارية وفي المشاريع والبرامج والخدمات التي تؤثر في الأطفال.

554. The Committee is concerned that the general principle of the best interests of the child contained in article 3 of the Convention is not expressly incorporated in all legislation concerning children and is not always considered in practice.
554- تعرب اللجنة عن قلقها لعدم ورود نص صريح فيما يتعلق بالمبدأ العام المتمثل في مصالح الطفل الفضلى الوارد في المادة 3 من الاتفاقية في جميع التشريعات المتعلقة بالأطفال وعدم أخذه دوماً في الحسبان في الممارسة الفعلية.

55. Participation and inclusion of persons with disabilities is both a general principle of the Convention on the Rights of Persons with Disabilities and a core obligation of States parties.
