7. Article 155 of the Act provides: " Without prejudice to any higher penalty prescribed in any other law:

14. Article 3 of the Children's Act states: " The provisions of this Act shall take precedence over any conflicting provision in any other law in order to serve the child's best interests and to the extent that the conflict is thereby eliminated. "
14- كما أن المادة 3 من قانون الطفل تنص على أن تسود أحكام هذا القانون على أي حكم يتعارض معها تأويلاً لمصلحة الطفل في أي قانون آخر إلى المدى الذي يزيل ذلك التعارض.

As article 104 of the Decree provides: " Without prejudice to any higher penalty prescribed in any other law, a fine of up to YRIs 10,000 or a term of up to one year's imprisonment shall be imposed on anyone who breaches the present law. "
وقد نصت المادة رقم 104 من هذا القانون على أنه " مع عدم الإخلال بأي عقوبة أشد في أي قانون آخر يعاقب كل من خالف هذا القانون بغرامة لا تزيد عن 000 10 ريال أو بالحبس لمدة لا تزيد عن سنة واحدة " .

“any police officer not below the rank of Superintendent or any other police officer not below the rank of sub-Inspector authorized in writing by him ... may, without warrant, ... notwithstanding anything in any other law to the contrary

" (1) Notwithstanding anything contained in any other law for the time being in force, where the Attorney General grants a request by a foreign State to obtain evidence in Tonga, an authorised officer may apply to the Supreme Court for:

16. Article 163 of the Children's Rights Act states that, without prejudice to any higher penalty laid down in any other law, a term of up to 10 years' imprisonment shall be imposed on anyone who incites a male or female child to engage in debauchery or prostitution.
16- وعاقب قانون حقوق الطفل في المادة 163 منه على أنه مع عدم الإخلال بأي عقوبة أشد منصوص عليها في أي قانون آخر يعاقب بالحبس مدة لا تزيد عن عشر سنوات كل من حرض طفلاً ذكراً كان أو أنثى على ممارسة الفجور والدعارة.

49. Article 3 of the Child Act states: " The provisions of this Act shall take precedence over any conflicting provision in any other law in order to serve the child's best interests and to the extent that the conflict is thereby eliminated. "
50- كما أن المادة 3 من قانون الطفل تنص على ما يلي: " تسود أحكام هذا القانون على أي حكم يتعارض معها تأويلاً لمصلحة الطفل في أي قانون آخر إلى المدى الذي يزيل ذلك التعارض " .

Moreover, article 3 of the Act stipulates: " The provisions of this Act shall prevail over any other provision in any other law, upon inconsistency thereof, to the extent of removing such inconsistency. "
كما أن المادة 3 من هذا القانون تنص على ما يلي: " تسود أحكام هذا القانون على أي حكم في أي قانون آخر يتعارض معه تأويلاً لمصلحة الطفل إلى المدى الذي يزيل ذلك التعارض " .

8. Article 164 of the Act stipulates: " Without prejudice to any higher penalty prescribed in any other law, a term of from 10 to 15 years' imprisonment shall be imposed on anyone who buys, sells, or otherwise disposes of a male or female child. "
8- وجاء في المادة 164 من القانون نفسه ما يلي: " مع عدم الإخلال بأي عقوبة أشد منصوص عليها في أي قانون آخر يعاقب بالحبس مدة لا تقل عن عشر سنوات ولا تزيد عن خمس عشرة سنة كل من اشترى أو باع أو تصرف بأي شكل كان في طفل ذكراً أو أنثى " .

15. Article 77(e) of the Child Act 2010 stipulates that " death sentence is not inflicted on the Child " . We have already referred to the child definition (18 years) in paragraph 7 of this document, whereby we have mentioned that article 3 of the Act stipulates: " The provisions of this Act shall prevail over any other provision in any other law, upon inconsistency thereof, to the extent of removing such inconsistency " .
15- نص قانون الطفل 2010 في المادة 77/2 ألا توقع عقوبة الإعدام على الطفل.وقد سبق أن أشرنا إلى تعريف الطفل (18 سنة) في الفقرة 7 أعلاه من هذه الوثيقة حيث ذكرنا أن المادة 3 من هذا القانون نصت على أن تسود أحكام هذا القانون على أي حكم في أي قانون آخر يتعارض معه تأويلاً لمصلحة الطفل إلى المدى الذي يزيل ذلك التعارض.
