Paragraph 1 addressed the general case of countermeasures taken by an international organization against a State or another international organization and referred explicitly to the substantive and procedural conditions required by international law for the taking of countermeasures, some of which were listed in Chapter II of Part Four of the draft articles.

That principle has been reaffirmed by other international tribunals and in State practice. In some contexts it affects the quantum of compensation itself, and thus concerns issues already dealt with in Chapter II of Part Two.

Thus a particular treaty might impose obligations on a State but define the " State " for that purpose in a way which produced different consequences than would otherwise flow from the rules of attribution in Chapter II of Part 1.

With regard to countermeasures that an international organization may take against another international organization, it would be coherent to consider that a circumstance precluding wrongfulness justifies an otherwise wrongful act subject to the conditions set out in Chapter II of Part Three, which covers countermeasures taken both by international organizations and by States against an international organization.
