It had commenced substantive consideration of the topic of subsequent agreements and subsequent practice in relation to the interpretation of treaties, following the appointment in 2012 of a Special Rapporteur for the topic, and had provisionally adopted draft conclusions.

In State practice as reflected in the case law of international courts, it may often be observed that disputes arise in relation to the interpretation or application of the text of a treaty, either bilateral or multilateral, or the interpretation of a unilateral act, whether an act that intervenes in a treaty relationship or an independent unilateral act.
