3.2 The complainant submits that torture is systematic in Uzbekistan and that, in particular, suspected participants in the Andijan events are persecuted and subjected to mass arbitrary arrest and torture.
3-2 ويدفع مقدّم الشكوى بأن التعذيب يمثل ممارسة منهجية في أوزبكستان وأن المشتبه في مشاركتهم في أحداث أنديجان على وجه الخصوص يضطهدون ويتعرضون للاعتقال التعسفي والتعذيب بصورة جماعية.

He maintains that, according to Amnesty International, individuals such as his brother are at a heightened risk of being ill-treated and that the Special Rapporteur on the question of torture has requested countries to refrain from handing over individuals accused of participating in the Andijan events to the Uzbek authorities.
ويؤكد مقدم الشكوى بناء على إفادات منظمة العفو الدولية أن الأفراد الذين هم في مثل حالة أخيه معرضون لسوء المعاملة بصورة كبيرة وأن المقرر الخاص المعني بالتعذيب طلب إلى البلدان الامتناع عن تسليم الأشخاص المتهمين بالمشاركة في أحداث أنديجان إلى السلطات الأوزبكية.

11.6 The Committee notes that the complainant's brother's extradition is sought pursuant to a request from Uzbekistan accusing him of serious crimes, including terrorism, religious extremism, attempts to overthrow the constitutional order and, in particular, participation in the Andijan events.

وبالنظر إلى ظروف هذه القضية، رأت اللجنة أن المعلومات المعروضة عليها تؤكد بما فيه الكفاية وجود خطر ملموس للتعرض للتعذيب وغيره من ضروب المعاملة القاسية، والمعاملة اللاإنسانية أو المهينة في أوزبكستان، ولا سيما بالنسبة للأفراد المتهمين بالإرهاب أو بالمشاركة في أحداث أنديجان.

7.6 The complainant reiterates that his brother's extradition is sought in relation to terrorism charges and alleged participation in the Andijan events (see para 2.3 above) and that his brother's former co-workers, who have already been convicted on the same charges, were subjected to torture in order to extract their confessions.
7-6 ويؤكد مقدّم الشكوى أن طلب تسليم أخيه يرتبط بتهم الإرهاب والمشاركة المزعومة في أحداث أنديجان (انظر الفقرة 2-3 أعلاه) وأن زملاء أخيه السابقين الذين أدينوا بالفعل بهذه التهم تعرضوا للتعذيب بغرض انتزاع اعترافاتهم.

11.7 In the circumstances of the present case, the Committee considers that the information before it sufficiently establishes a pattern of gross, flagrant or mass violations of human rights and the significant risk of torture or other cruel, inhuman or degrading treatment in Uzbekistan, in particular for individuals accused of terrorism and of having participated in the Andijan events.
11-7 وفي الحالة قيد البحث، ترى اللجنة أن المعلومات المعروضة عليها تثبت بما يكفي وجود نمط ثابت من الانتهاكات الجسيمة والصارخة والجماعية لحقوق الإنسان وخطر بالغ للتعرض للتعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة في أوزبكستان، ولا سيما بالنسبة إلى الأشخاص المتهمين بالإرهاب والمشاركة في أحداث أنديجان.
