In paragraph 7 of its resolution 1996/15, the Economic and Social Council urged Member States in which the death penalty might be carried out to effectively apply the Standard Minimum Rules for the Treatment of Prisoners in order to keep to a minimum the suffering of prisoners under sentence of death and to avoid any exacerbation of such suffering.

The most recent case in which the death penalty was an option, was that of John Demjanjuk, who, after having been sentenced to death for war crimes, genocide and crimes against the Jewish people, was acquitted in 1993 on appeal to the Supreme Court due to a reasonable doubt as to whether he was indeed " Ivan the Terrible " from the Treblinka death camp.

In two additional resolutions adopted in 2003, the Commission called upon all States in which the death penalty had not been abolished to comply with their obligations as assumed under relevant provisions of international human rights instruments, including in articles 37 and 40 of the Convention on the Rights of the Child and articles 6 and 14 of ICCPR, keeping in mind the Safeguards.
