Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.
وينبغي أن يحظر القانون أي دعوة إلى الكراهية الوطنية أو العرقية أو الدينية تشكل تحريضا على التمييز أو العـداء أو العنف، وأن يحظر كذلك نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية أو التحريض على التمييز العنصري، وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال.

(a) Shall declare an offence punishable by law all dissemination of ideas based on racial superiority or hatred, and incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
(أ) اعتبار كل نشر للأفكار القائمة على التفوق العرقي أو الكراهية العرقية والتحريض على التمييز العنصري وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال ضد أي عرق أو أية مجموعة أشخاص من لون أو أصل عرقي آخر وتوفير أي مساعدة لأنشطة ذات طابع عنصري، بما في ذلك تمويلها، جريمة يعاقب عليها القانون؛

The four categories of misconduct mentioned in article 4(a) of the Convention are penalized: (1) dissemination of ideas based upon racial superiority or hatred; (2) incitement to racial hatred; (3) acts of violence against any race or group of persons of another colour or ethnic origin; and (4) incitement to such acts.

472. Concern is expressed at the insufficient legal framework to declare illegal and to prohibit non-political groups and associations which disseminate ideas based on racial superiority or hatred and incitement to racial discrimination, as well as acts of violence or incitement to such acts against any race or group of persons.
٤٧٢ - ويعرب عن القلق لعدم كفاية اﻹطار القانوني ﻹعلان عدم مشروعية وحظر المجموعات والرابطات غير السياسية التي تنشر أفكارا تقوم على التفوق العنصري أو الكراهية والحض على التمييز العنصري بالاضافة إلى أعمال العنف أو الحض على تلك اﻷعمال ضد أي عرق أو مجموعة من اﻷفراد.

3. Article 4 (a) requires States parties to penalize four categories of misconduct: (i) dissemination of ideas based upon racial superiority or hatred; (ii) incitement to racial hatred; (iii) acts of violence against any race or group of persons of another colour or ethnic origin; and (iv) incitement to such acts.
٣- وتطلب المادة ٤)أ( من الدول اﻷطراف أن تفرض عقوبات على أربع فئات لسوء السلوك: `١` نشر اﻷفكار القائمة على التفوق العنصري أو الكراهية العنصرية؛ و`٢` التحريــض على الكراهيــة العنصريــة؛ و`٣` أفعال العنف المرتكبة ضد أي عرق أو أية جماعة من اﻷشخاص من لون أو أصل إثني آخر؛ و`٤` التحريض على ارتكاب أفعال كهذه.

(c) To declare as an offence punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
(ج) اعتبار كل نشر للأفكار القائمة على التفوق العرقي أو الكراهية العنصرية، وكل تحريض على التمييز العنصري، وكل عمل من أعمال العنف أو التحريض على مثل هذه الأعمال يرتكب ضد أي عرق أو أية جماعة من لون أو أصل عرقي آخر ، وكذلك توفير أي مساعدة لأنشطة عنصرية، بما في ذلك تمويلها، جرائم يعاقب عليها القانون؛

Accordingly, Omani authorities and institutions do not perform any acts of racial discrimination or acts that may lead to support of or incitement to such acts.
ولا تقوم السلطات العمانية أو مؤسساتها تبعاً لذلك بممارسة أي عمل من أعمال التمييز العنصري أو مما يفضي إلى تأييد مثل هذه الأعمال أو دعمها أو التحريض عليها.

It is noted that domestic legislation lacks provisions to implement fully article 4 of the Convention, in particular, provision declaring punishable by law all acts of racist violence, the incitement to such acts and the provision of assistance to racist activities, as well as the prohibition of organizations, activities and propaganda which promote and incite racial discrimination.
وهي تلاحظ أن التشريع الداخلي يخلو من أحكام تنص على تنفيذ المادة ٤ من الاتفاقية بالكامل، ولاسيما حكم يعلن أن جميع أعمال العنف العنصري والتحريض على هذه اﻷعمال وتقديم المساعدة إلى اﻷنشطة العنصرية أعمال يعاقب عليها القانون فضلا عن حكم ينص على حظر المنظمات واﻷنشطة والدعاية التي تشجع التمييز العنصري وتحرض عليه.

Notes that article 4 (b) of the International Convention on the Elimination of All Forms of Racial Discrimination places an obligation upon States to be vigilant and to proceed against organizations that disseminate ideas based on racial superiority or hatred, acts of violence or incitement to such acts; those organizations shall be condemned and discouraged;
" 11 (ثالثا) - تلاحظ أن الفقرة (ب) من المادة 4 من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري تلقي على كاهل الدول التزاماً باليقظة وبمقاضاة المنظمات التي تروج أفكاراً قائمة على التفوق العنصري أو الكراهية العنصرية أو ترتكب أعمال عنف أو تحرض عليها.
