143. Accordingly, adoption of the definition contained in article 24, paragraph 1 ( " For the purposes of this Convention, `victim'means the disappeared person and any individual who has suffered harm as the direct result of an enforced disappearance " ), will necessitate consideration of the amendment of the Iraqi legal system in regard to criminal acts of enforced disappearance.
143- وعلى هذا الأساس فان الأخذ بالتعريف الوارد في المادة 24/1 " لأغراض هذه الاتفاقية، يقصد ﺑ `الضحية` الشخص المختفي وكل شخص طبيعي لحق به ضرر مباشر من جراء هذا الاختفاء القسري " يقتضي البحث في تعديل منظومة التشريعات العراقية ذات العلاقة بجريمة الاختفاء القسري.

34. The Committee expresses concern that French criminal law provides that the victim must have suffered direct and personal harm and that the two conditions are more restrictive than that under article 24, paragraph 1, of the Convention, which refers to both the disappeared person and any individual who has suffered harm as the direct result of enforced disappearance.
34- تعرب اللجنة عن قلقها من أن القانون الجنائي الفرنسي ينص على أن صفة الضحية تطلق على من لحق به ضرر مباشر وشخصي، وهذا الشرط المزدوج هو شرط أكثر تقييداً من الشرط المنصوص عليه في الفقرة 1 من المادة 24 من الاتفاقية والتي تعرِّف الضحية بأنه الشخص المختفي وكل شخص طبيعي لحق به ضرر مباشر بسبب الاختفاء القسري.
