إلا أن مكانة الميثاق الوطني من الناحية القانونية لا تزال مبهمة حيث يعتبر الميثاق وثيقة فكرية لولا تتوفر سوابق قضائية حتى الآن عن مكانة الميثاق، الأمر الذي يتطلب إقراراً قضائياً عن مكانة الميثاق في التشريعات الأردنية وإعطائه حق الإلزامية قبل أن نشعر بارتياح بالنسبة للمساواة بين الجنسين.

41. Jordanian legislation recognizes the right of the child to express his or her opinion orally, in writing or through the available information media, including children's radio and television programmes and the children's sections of the official daily newspapers.
41- لقد تضمنت التشريعات الأردنية حق الطفل في التعبير عن رأيه بالقول والكتابة بوسائل الإعلام المتاحة له من خلال البرامج التلفزيونية والاذاعية المخصصة للأطفال وأيضاً من خلال الملاحق الخاصة للأطفال في الصحف اليومية الرسمية.

130. A new Directorate, known as the International Relations Directorate, has been created within the Ministry of Justice. It is mandated to attain a set of objectives, one of which is to ensure that Jordanian legislation conforms to the country's commitments arising from international instruments to which it is a party, including instruments relating to the rights of the child.

77. The Government of Jordan reconfirms what has been mentioned in paragraph 50 of its national report that the Jordanian legislation guarantees the right of any person who believes he was tortured to bring his case to court and lodge a complaint against the person or party he claims to have committed the torture. A person also has the right to take civil action to demand compensation by virtue of article 256 of the Civil Law.
77- تعيد الحكومة الأردنية التأكيد على ما ورد في الفقرة 50 من تقريرها الوطني، حيث تضمن التشريعات الأردنية حق أي شخص يعتقد أنه تعرض للتعذيب باللجوء إلى القضاء وتقديم شكوى ضد الشخص أو الجهة التي يدعي عليها، وله الحق بإقامة دعوى مدنية للمطالبة بالتعويض بموجب المادة 256 من القانون المدني.

4. Jordanian legislation (article 100 of the amended Criminal Proceedings Law No. 16 of 2001) has determined the period of detention of an accused person at police stations to be 24 hours, after which the accused shall be referred to the concerned public prosecutor as the legal authority in charge of the investigation.

40. Jordanian legislation, namely article 100 of the amended Code of Criminal Procedure no. 16 of 2001, determines the time that a defendant may be held at a police station as 24 hours, after which he or she should be brought before the Office of the Attorney General, which is the competent judicial body for the conduct of the investigation.
40- لقد حددت التشريعات الأردنية (المادة 100 من قانون أصول المحاكمات الجزائية المعدل رقم 16 لسنة 2001) مدة الاحتفاظ بالمشتكى عليه لدى مراكز الشرطة ب24 ساعة تتم بعدها إحالته إلى المدعي العام المختص باعتباره الجهة القضائية المكلفة بإجراء التحقيق.

The Jordanian legislation criminalizes acts which on the one hand, have a negative impact on the proper and fair administration of justice (crimes against the judicial administration and crimes against the course of justice), but, on the other, do not seem to fully and precisely meet the requirements set forth in article 25 of UNCAC to establish as criminal offences a broad range of specific conducts resulting in obstruction of justice.
وتجرّم التشريعات الأردنية الأفعال التي تؤثّر سلباً على حسن سير العدالة وإقامة العدل (الجرائم ضدّ الإدارة القضائية وجرائم إعاقة سير العدالة)، لكن لا يبدو أنّها تلبي على نحو تام ودقيق المتطلبات الواردة في المادة 25 من اتفاقية مكافحة الفساد والرامية إلى تجريم طائفة واسعة من التصرّفات المعيّنة التي تفضي إلى إعاقة سير العدالة.

That fact, and the comments made by previous speakers, indicated that the situation concerning equality between the sexes under Jordanian legislation left something to be desired.
وهذه الحقيقة، والتعليقات التي أبداها المتحدثون السابقون عليه، تبين أن الوضع الخاص بالمساواة بين الجنسين في ظل التشريع اﻷردني ما زال يفتقر إلى الكثير.

15. While noting with appreciation the ongoing efforts to implement measures pursuant to the State party's amendments to its Constitution in September 2011, the Committee remains concerned at the continued absence of a Constitutional Court to oversee the conformity of Jordanian legislation with the Constitution and the Convention.
15- وفيما تأخذ اللجنة علماً مع الارتياح بجهود الدولة الطرف المستمرة لتنفيذ التدابير وفقاً للتعديلات التي أدخلتها على دستورها في أيلول/سبتمبر 2011، لا تزال تشعر بالقلق إزاء استمرار غياب المحكمة الدستورية للإشراف على تطابق القوانين الأردنية مع الدستور والاتفاقية.
