It should be noted that paragraph 3 of Article 71 of the new Code of Criminal Procedure approved on 14 of March, 2002 (has not yet come into force) stipulates that a citizen of the Republic of Lithuania or a foreigner may not be extradited (a wording similar to that used in the Convention) if the person is prosecuted for an offence of political nature.
