Judge Aguilar Mawdsley became a member of the Court on 6 February 1991.

The member elected to replace Judge Andrés Aguilar Mawdsley will thus serve until 5 February 2000.
وبذلك سيشغل العضو المنتخب بدلا من القاضي أندريس أغيلار مودسلي منصبه حتى ٥ شباط/فبراير ٢٠٠٠.

I should also like to express our sorrow at the death on 24 October 1995 of Judge Andrés Aguilar Mawdsley, an illustrious Venezuelan and Latin American jurist, who made such a decisive contribution to the cause of law.

It notes that with the exception of the observation that Mr. Mawdsley's second deportation in 1998 was conditional in that if he entered the country again he would be required to serve his sentence, none of the source's allegations have been refuted by the Government.

It confirmed that James Mawdsley had entered the country three times, in its opinion illegally, and added that his second deportation from Myanmar in 1998 was subject to the condition that if he entered the country again - which occurred in August 1999 - he would serve his suspended prison sentence.

In the circumstances, the Working Group sees no reason to change its conclusion that the detention of James Mawdsley was arbitrary.*
