Mr. Mehlis recommends, pursuant to paragraph 8 of resolution 1636 (2005), that the mandate of the Commission be extended for a period of six months to enable the investigation to continue.

The members of the Council issued a statement to the press on 13 January, in which they welcomed the Secretary-General's decision to appoint Serge Brammertz as the Commissioner of the International Independent Investigation Committee into the assassination of former Prime Minister Rafiq Hariri and commended his predecessor, Detlev Mehlis, for his outstanding work.
أصدر أعضاء المجلس بيانا صحفيا في 13 كانون الثاني/يناير يرحب فيه بقرار الأمين العام بتعيين سيرج براميرتز مفوضا للجنة التحقيق الدولية المستقلة المكلفة بالتحقيق قي اغتيال رئيس الوزراء السابق رفيق الحريري، وأثنى على سلفه ديتلف مهليس على عمله المتميز.

However, following the replacement of Mr. Mehlis by Mr. Brammertz as Head, the Investigation Commission has indicated that the relations between the International Independent Investigation Commission operate " within the framework of Lebanese sovereignty and of its legal system " and that the Lebanese judicial authorities have exclusive competence with regard to questions of detention.

At the 5323rd meeting, in accordance with the understanding reached in the Council's prior consultations, the President, with the consent of the Council, extended an invitation under rule 39 of the Council's provisional rules of procedure to Detlev Mehlis, Commissioner of the United Nations International Independent Investigation Commission.
