6.1 On 6 February 2009, the State party submitted observations on the merits of the complaint.

The State party shall be informed that such a request does not imply a determination of the admissibility or the merits of the complaint.

4. The Committee may invite the complainant or his/her representative and representatives of the State party concerned to be present at specified closed meetings of the Committee in order to provide further clarifications or to answer questions on the merits of the complaint.

Unless the Committee, the Working Group or a rapporteur decides, because of the exceptional nature of the case, to request a reply that relates only to the question of admissibility, the State party shall include in its reply explanations or statements that shall relate both to the admissibility and the merits of the complaint as well as to any remedy that may have been provided.
وإذا لم تقرر اللجنة أو الفريق العامل أو المقرر، بسبب الطبيعة الاستثنائية للحالة، طلب إجابة لا تتصل إلا بمسألة المقبولية، يجب على الدولة الطرف أن تدرج في إجابتها تفسيرات أو بيانات تتصل بمقبولية الشكوى وموضوعيتها على السواء، فضلاً عن أي انتصاف قد يكون تم تقديمه لمقدم الشكوى.

Therefore, as concerns the merits of the complaint, the State party relies on the decisions of the Migration Board and the Migration Court and on the reasoning set out therein.

8.3 Concerning the merits of the complaint and the reasons for the deportation, the State party considers the complaint to be unfounded for the following reasons.
8-3 وفيما يتعلق بالأسس الموضوعية للشكوى وأسباب الترحيل، ترى الدولة الطرف أن الشكوى لا تقوم على أساس، وذلك للأسباب التالية.

Unless the Committee, the working group or a rapporteur decide, because of the exceptional nature of the case, to request a reply only in respect of the question of admissibility, the State party shall include in its reply explanations or statements relating both to the admissibility and the merits of the complaint, as well as to any remedy that may have been provided.
وما لم تقرر اللجنة أو الفريق العامل أو المقرر، بسبب الطبيعة الاستثنائية للحالة، طلب تقديم رد يقتصر على مسألة المقبولية فقط، يجب على الدولة الطرف أن تدرج في ردها تفسيرات أو بيانات تتعلق بمقبولية الشكوى وبأسسها الموضوعية على السواء، فضلاً عن أي انتصاف يكون قد أتيح لمقدم الشكوى.

To expedite the consideration of the communications, the Committee invited the States parties, in case they would have no objections to the admissibility of the communications, immediately to furnish information related to the merits of the complaint.
ولتعجيل النظر في هذه الرسائل، دعت اللجنة الدول اﻷطراف، إذا لم يكن لديها أية اعتراضات على مقبولية الرسائل، أن تقدم على الفور معلومات بصدد موضوع الشكوى.
