The Committee recalls that under article 21 of the Covenant, any restriction on the right of peaceful assembly must be imposed in conformity with the law and must be necessary in a democratic society for one of the public purposes specified in the Covenant, namely, the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others.

10.6 Regarding the author's claim under article 21 of the Covenant, the Committee considers that the State party has failed to demonstrate that the restrictions imposed on the author were necessary in the interests of national security or public safety, public order, the protection of public health or morals or the protection of the rights and freedoms of others.
