The Rome Statute of the International Criminal Court, ratified by the Democratic Republic of the Congo on 30 March 2002, defines as a war crime the conscription or enlistment of children under the age of 15 into national armed forces or armed groups and their active participation in hostilities.

14. The Committee welcomes the amendment of the Criminal Code (art. 136) which makes it a criminal offence to recruit persons under 18 years of age into armed groups other than the national armed forces or to involve them in hostilities as part of such armed groups.
