The procuring entity shall ensure that the number of suppliers or contractors invited to participate in the dialogue, which shall be at least three, if possible, is sufficient to ensure effective competition.

1. The procurement regulations are to provide an exhaustive list of circumstances that would justify the ERA to proceed if the number of suppliers or contractors registered for the auction is insufficient to ensure effective competition.

[2. The procuring entity may impose a maximum limit on the number of suppliers or contractors that can be registered for the electronic reverse auction only to the extent that capacity constraints in its communications system so require, and shall select the suppliers or contractors to be so registered in a non-discriminatory manner.

(c) If the framework agreement will be concluded with more than one supplier or contractor, any minimum or maximum limit on the number of suppliers or contractors that will be parties thereto;

3. Once announced, the ERA will be the method of selecting the successful supplier or contractor, unless the number of suppliers or contractors participating is insufficient to ensure effective competition.

Paragraph (2) allows the procuring entity to cancel the auction if the number of suppliers or contractors registered for the auction is insufficient to ensure effective competition.
2- وتتيح الفقرة (2) للجهة المشترية إلغاء المناقصة إذا كان عدد المورِّدين أو المقاولين المسجّلين في المناقصة غير كاف لضمان تنافس فعّال.

(3) For the purpose of limiting the number of suppliers or contractors from which to request proposals, the procuring entity may engage in preselection proceedings.
(3) لغرض الحدّ من عدد المورِّدين أو المقاولين الذين سوف تُطلَب منهم الاقتراحات، يجوز للجهة المشترية أن تقوم بإجراءات اختيار أولي.

(2) If the number of suppliers or contractors registered for the electronic reverse auction is insufficient to ensure effective competition, the procuring entity may cancel the auction.
(2) إذا كان عدد المورِّدين أو المقاولين المسجلين في المناقصة الإلكترونية غير كاف لضمان تنافس فعّال، جاز للجهة المشترية أن تلغي المناقصة.

The 2011 text introduced the possibility of (a) holding a pre-selection procedure for the purpose of limiting the number of suppliers or contractors from which to request proposals and (b) establishing a maximum number of suppliers or contractors that can be invited to participate in the dialogue.
42- وأقر نص قانون 2011 إمكانية (أ) القيام بإجراءات اختيار أولي لغرض الحدّ من عدد المورِّدين أو المقاولين الذين سوف تُطلَب منهم الاقتراحات، و(ب) تحديد العدد الأقصى للمورِّدين أو المقاولين الذين يمكن دعوتهم إلى المشاركة في الحوار.

[(k) If any limit on the number of suppliers or contractors that can be registered for the auction is imposed in accordance with paragraph 2 of this article, the relevant maximum number and the criteria and procedure, in conformity with paragraph 2 of this article, that will be followed in selecting it;]

The criteria for closing the auction may need to be determined when the number of suppliers or contractors registered for the auction and other information that affects the structure of the auction (whether it would be held in one round or several subsequent rounds) are known.

(g) Where the procuring entity intends to limit the number of suppliers or contractors that it will invite to participate in the dialogue, the minimum number of suppliers or contractors, which shall be not lower than three, if possible, and, where appropriate, the maximum number and the criteria and procedure, in conformity with the provisions of this Law, that will be followed in selecting it;

(b) Where the limitation on the number of suppliers or contractors that can be invited to participate in the dialogue was established and the number of responsive proposals exceeds that maximum, the procuring entity shall select the maximum number of responsive proposals in accordance with the criteria and procedure specified in the request for proposals;

15. Paragraph (2) dealing with the imposition of a maximum number of suppliers or contractors that can be registered for the auction has been discussed in connection with paragraph (1) (k) of the article (see paragraph 8 above).

Another suggestion was to delete some provisions in the proposed paragraph so that the entire paragraph would read as follows: " The solicitation documents must set out the minimum number of suppliers or contractors, which shall be not less than three, [if possible,] which the procuring entity intends to invite to participate in the negotiations and, where appropriate, the maximum number. "
