With regard to the second part of the question, it should be noted that the category of domestic workers had previously not been subject to labour legislation but only to the general rules contained in the Obligations and Contracts Act.

1. The provisions of the Code of Obligations and Contracts

97. Every person, male or female, who is over 18 years of age, in principle enjoys actual legal capacity in accordance with article 7 of the Code of Obligations and Contracts.
97- يتمتع مبدئياً بأهلية الأداء وفق أحكام الفصل 7 من مجلة الالتزامات والعقود كل شخص ذكراً كان أو أنثى بلغ من العمر ثمانية عشرة سنة كاملة.

Please also indicate the measures taken and envisaged to eliminate all discriminatory provisions from national legislation, including from the Personal Status Code and the Penal Code, and to withdraw from the Code of Obligations and Contracts the provision that the testimony of two women is equal to that of one man.

202. The rights of tenants are provided in the Law on Obligations and Contracts (1951), the Housing Rent Law (1973), and article 415, paragraphs 4 and 5 of the Civil Procedure Code.

208. This is a group which is excepted from the provisions of the Labour Code. The relation between foreign female domestic workers and employer are governed by the Code of Obligations and Contracts, the law regulating foreign labour and the practical provisions supplementary thereto.
208- هي فئة مستثناة من أحكام قانون العمل، يحكم علاقتها مع صاحب العمل (المخدوم) قانون الموجبات والعقود وقانون تنظيم عمل الأجانب والنصوص التطبيقية المتمّمة له.

209. Lebanese law contains no provisions that discriminate on racial or ethnic grounds and the subjection of foreign female domestic workers to the Code of Obligations and Contracts is not evidence of discrimination, since similar female Lebanese workers are subject to the same provisions without discrimination, as the judgement of the Lebanese courts has established.
209- لا تتضمّن القوانين اللبنانية نصوصاً تقوم على التمييز العنصري أو العرقي، ولا ينمّ إخضاع عاملات المنازل الأجنبيات إلى قانون الموجبات والعقود عن أي تمييز من هذا القبيل، ذلك أن العاملات المماثلات اللبنانيات يخضعن للأحكام نفسها دون أي تمييز. وهذا ما استقرّ عليه أيضاً اجتهاد المحاكم اللبنانية.

Lebanese law accords women, equally with men, full competence to enter into and conclude contracts relating to credit, real estate and the administration of property (article 215 of the Code of Obligations and Contracts).
ويعطي القانون اللبناني المرأة على قدم المساواة مع الرجل الأهلية التامة للإلتزام وإبرام العقود المتعلّقة بالإئتمان والعقارات وإدارة الممتلكات (المادة 215 من قانون الموجبات والعقود).

315. Lebanese law does not discriminate between men and women except as to the extent of the loss sustained by each and the extent of responsibility of each (article 122 and 234 of the Code of Obligations and Contracts).

20. Article 995, paragraph 1, of chapter III of the Lebanese Code of Obligations and Contracts, entitled “Life insurance”, provides that “Life insurance contracted by a third party on the life of the insured person shall be null and void if the latter has not given his consent in writing, indicating the amount insured”.
٠٢- وقد نص في الفقرة اﻷولى من المادة ٥٩٩ من الفصل الثالث من قانون الموجبات والعقود اللبناني، المعنون " في التأمين على الحياة " على ما يلي: " يكون التأمين في حالة الوفاة، الذي يعقده شخص ثالث باسم المؤمن له، باطلاً إذا لم يوافق هذا اﻷخير عليه خطياً، مع بيان مبلغ التأمين " .

The appeal judges expressly declared that in the Tunisian Legal System the UNLOC should be applied with priority over internal law, notably the Code of Obligations and Contracts promulgated in 1906. The UNLOC is to be considered the first source of law when there is a question of independent guarantees and standby letters of credit.
وأعلن قضاة الاستئناف صراحة أنه ينبغي، وفق النظام القانوني التونسي، وعلى وجه الخصوص قانون العقود والالتزامات الصادر في عام 1906،() أن تكون الأولوية في التطبيق لاتفاقية الكفالات وخطابات الاعتماد لا للقانون الداخلي، وقالوا إنه يجب اعتبار هذه الاتفاقية المرجع القانوني الرئيسي عندما يتعلق الأمر بالكفالات المستقلة وخطابات الاعتماد الضامنة.
