One of the fundamentals of the right to due process for everyone charged with a criminal offence is to “examine, or have examined, the witnesses against him and to obtain the attendance and examination of witnesses on his behalf under the same conditions as witnesses against him”. (Covenant on Civil and Political Rights, art. 14,3 (e)).

In all three cases, the Appeals Chamber found no error in the finding that the accused persons' right to obtain the attendance of, and to examine, defence witnesses under the same conditions as witnesses called by the prosecution could not be guaranteed in Rwanda at the time.
