63- وأعرب أحد الوفود عن رأي مفاده أن تعريف الفضاء الخارجي وتعيين حدوده يمكن أن يكونا ضروريين لتحديد نطاق تطبيق قانون الجو وقانون الفضاء.

The view was expressed that the delimitation of outer space was important for determining the scope of application of air law and space law.
82- وأعرب أحد الوفود عن رأي مفاده أن تعيين حدود الفضاء الخارجي أمر هام لتحديد نطاق تطبيق قانون الجو وقانون الفضاء.

The regime of air law should apply to craft that temporarily enter outer space during Earth-to-Earth missions to transport materials or persons.
وينبغي أن تطبق قواعد قانون الجو على المركبة التي تدخل بصفة مؤقتة إلى الفضاء الخارجي أثناء قيامها ببعثات من الأرض إلى الأرض لنقل معدات أو أشخاص.

(a) The rules of air law generally apply to airspace (spatialist basis) or to aircraft (functionalist basis);
(أ) تنطبق قواعد قانون الجو بوجه عام على الفضاء الجوي (الأساس الفضائي) أو على الطائرات (الأساس الوظيفي)؛

Some delegations expressed the view that a functional approach would be efficient for determining the scope of application of air law and space law.
6- وأَعرب بعض الوفود عن رأي مفاده أنَّ اتِّباع نهج وظيفي من شأنه أن يكون أسلوباً ناجعاً في تحديد نطاق تطبيق قانون الجو وقانون الفضاء.

In that connection, the delegation that expressed that view was also of the view that such work would assist the determination of international priorities in areas of air law and space law that had developed independently of each other.
وفي هذا الصدد، أبدى الوفد الذي أعرب عن هذا الرأي رأياً آخر أيضاً في أنَّ من شأن هذا العمل أنْ يساعد على تعيين الأولويات الدولية ضمن مجالات قانون الجو وقانون الفضاء التي تطوَّرت على نحوٍ مستقل عن بعضها بعضاً.

With regard to rules of air law that apply to international airspace, an aerospace object is subject to the law of the State where it is registered (principle of nationality).
وفيما يتعلق بقواعد قانون الجو التي تنطبق على الفضاء الجوي الدولي، يخضع الجسم الفضائي الجوي لقانون الدولة التي يكون مسجّلا فيها (مبدأ الجنسية).

(d) With regard to functionalist-based rules, the concept of " aircraft " is rather well defined, whereas the concept of " space objects " is not and the application of functionalist-based rules of air law as well as space law to one and the same object is not precluded.
(د) فيما يتعلق بالقواعد القائمة على أساس وظيفي، فإن مفهوم " الطائرة " معرّف تعريفا جيدا، في حين أن مفهوم " الأجسام الفضائية " ليس كذلك، وليس هنالك ما يمنع تطبيق قواعد قانون الجو وكذلك قانون الفضاء القائمة على أساس وظيفي على الجسم ذاته.

Some delegations expressed the view that the lack of a definition or delimitation of outer space created legal uncertainty concerning the applicability of air law and space law and that matters concerning State sovereignty and the boundary between airspace and outer space needed to be clarified in order to reduce the possibility of disputes among States.
75- وأَعرب بعض الوفود عن رأي مفاده أنَّ عدم وجود تعريف للفضاء الخارجي أو تعيين لحدوده يحدث بلبلة قانونية بشأن انطباق قانون الجو أَم قانون الفضاء، وأنَّ من الضروري توضيح المسائل المتعلقة بسيادة الدول والحدود بين الفضاء الجوي والفضاء الخارجي بغية الحدِّ من احتمالات نشوء نـزاعات بين الدول.

If it is a space mission, the norms of air law should not apply to its outgoing and return flight paths.
فإن كانت الرحلة رحلة فضائية، فلا ينبغي أن تنطبق قواعد القانون الجوي على مسار رحلتها في الذهاب أو في الإياب.

Similarly, customary law does exist with respect to such aerospace objects, whereby they are regarded as craft performing a space mission to which the norms of air law do not apply.
ومن جهة أخرى، لا يوجد قانون عرفي فيما يتعلق بتلك الأجسام الفضائية الجوية بحيث يمكن أن تعتبر مركبات تقوم برحلات فضائية لا تنطبق عليها قواعد القانون الجوي.

7- وأبدى بعض الوفود رأياً مفاده أن اتباع نهج وظيفي سيكون ناجعا في تحديد نطاق تطبيق القانون الجوي وقانون الفضاء.

The rules of air law cover a wide range of air activities, which cover the sovereignty of a State over its airspace, registration of aircraft and crimes committed on board, the recognition of the rights thereto, the responsibility involved in operating the aircraft in terms of damage to passengers and their luggage, seizure of aircraft and other provisions.
فقواعد القانون الجوي تغطّي مساحة عريضة من الأنشطة الجوية، تتناول سيادة الدولة على فضائها الجوي، وتسجيل الطائرة، والجرائم التي ترتكب على متنها، والاعتراف بالحقوق فيها، والمسؤولية التي ينطوي عليها تشغيل الطائرة من حيث الأضرار التي تصيب ركّابها وأمتعتهم، والحجز التحفّظي على الطائرة، وغيرها من الأحكام.

2. We consider that the norms of air law should be applicable to aerospace objects to the same extent as they are applicable to aircraft of a foreign State since, when an aerospace object of one State is in the airspace of another State, it is treated as an aircraft and subject to the air law of the latter State and to international air law.
2- ونحن نرى أن قواعد القانون الجوي ينبغي أن تنطبق على الأجسام الفضائية الجوية بقدر ما تنطبق على المركبات الجوية لدولة أجنبية لأن الجسم الفضائي عندما يحلق في الفضاء الجوي لدولة أخرى يعامل معاملة المركبة الجوية ويخضع للقانون الجوي لتلك الدولة والقانون الجوي الدولي.

To the extent that the application of the provisions of air law to space objects while in airspace is accepted, articles 1827 to 1840 of Colombia’s Commercial Code, in its aeronautical section, contain provisions concerning, inter alia, damage to third parties on the surface of Earth.
نقبل في هذا الصدد تطبيق قواعد القانون المنظم للملاحة الجوية على اﻷجسام الفضائية في الفضاء الجوي . فالمواد ٧٢٨١ الى ٠٤٨١ في الفرع الخاص بالملاحة الجوية من القانون التجاري الكولومبي ، تضم أحكاما تتعلق بأمور منها اﻷضرار التي تلحق بالغير على سطح اﻷرض .
