The performance of an engagement encompasses auditing procedures aimed at the detection of the defalcation of books and records and other irregularities only if during the conduct of audits grounds therefor arise or if this has been expressly agreed to in writing.
ولا يشمل تنفيذ إحدى المهام تطبيق إجراءات مراجعة الحسابات بغية كشف عمليات الغش في نظام مسك الدفاتر والسجلات وغير ذلك من المخالفات إلا إذا نشأت خلال مراجعة الحسابات أسباب تستدعي ذلك، أو إذا كان قد تم الاتفاق على ذلك خطيا وصراحة.

4. Each State Party shall take the necessary measures, in accordance with its domestic laws and regulations regarding the maintenance of books and records, financial statement disclosures and accounting and auditing standards, to prohibit the following acts performed for the purpose of committing any of the offences established in articles [...] of this Convention:
4- تتخذ كل دولة طرف، وفقا لقوانينها ولوائحها التنظيمية الداخلية المتعلقة بحفظ الدفاتر والسجلات وكشف البيانات المالية ومعايير المحاسبة ومراجعة الحسابات ما يلزم من تدابير لحظر القيام بالأفعال التالية بغرض ارتكاب أي من الأفعال المجرمة في المواد [...] من هذه الاتفاقية:

It was proposed that the obligations of the insolvency representative in recommendation (78) should be cross-referenced to the recommendations concerning the debtor, and corresponding obligations for the insolvency representative to take action be included, such as to take possession of books and records.
84- واقترح أن توصل التزامات ممثل الاعسار الواردة في التوصية (78) باشارة مرجعية الى التوصيات المتعلقة بالمدين، وأن تدرج الالتزامات الموافقة لها بشأن اتخاذ ممثل الاعسار اجراءات، مثل حيازة الدفاتر والسجلات.

ورأى القاضي أنَّ اللجنة الأسترالية للأوراق المالية والاستثمار تتحمل مسؤوليات عن الإشراف على المصفِّين في إطار أدائهم لواجباتهم، وأنَّ اللجنة قد تشترط عليهم الحصول على إذن قبل اتخاذ إجراءات معيّنة (من قبيل تمزيق الدفاتر والسجلات) وأنَّ لديها القدرة على تجريد أيِّ شخص من صلاحية القيام بمهمة التصفية أو إبطال هذه الصلاحية.
