3.2 The author alleges a violation of article 14, paragraph 1, and the principle of equality before the courts.

If the principle of equality before the courts and the right to a fair trial is to be respected, a party to the proceedings who does not understand or speak the language used in the courts must have the assistance of an interpreter free of charge and be given a translation of the main procedural decisions.
وتقتضي مراعاة مبدأ المساواة أمام المحاكم والحق في محاكمة منصفة أن يحصل طرف الدعوى الذي لا يفهم أو لا يتكلم اللغة التي يستخدمها القضاء على مساعدة مترجم فوري مجاناً وأن يحصل على ترجمة أهم الإجراءات.

The Committee considers that these circumstances disclose a failure of the Court of Appeal to provide full opportunity to each party to challenge the submissions of the other, thereby violating the principles of equality before the courts and of fair trial contained in article 14, paragraph 1, of the Covenant.

6 - تضمن حكومة السودان الحق في المحاكمة العلنية العادلة، والحق في اللجوء إلى العدالة في جميع الدعاوى المدنية والإدارية والجنائية على أساس من المساواة أمام المحاكم بأنواعها.

6.3 With regard to the alleged violation of equality before the courts (art. 14, para. 1), the Committee notes that the author has complained about the outcome of the judicial proceedings, compared to the outcome of another similar case.

5- تطلب إلى الدول أن تكفل احترام مبادئ المساواة أمام المحاكم والقانون في نظمها القضائية، وذلك بجملة أمور منها منح الأشخاص قيد المحاكمة إمكانية استجواب شهود الادعاء بأنفسهم أو من قبل طرف آخر، وضمان حضور شهود الدفاع واستجوابهم في ظروف مماثلة؛

6. Calls upon States to ensure that the principles of equality before the courts and before the law are respected within their judicial systems, inter alia by providing to those being tried the possibility to examine, or to have examined, the witnesses against them and to obtain the attendance and examination of witnesses on their behalf under the same conditions as witnesses against them;
6- تطلب إلى الدول أن تكفل احترام مبادئ المساواة أمام المحاكم والقانون في نظمها القضائية، وذلك بجملة أمور منها منح الأشخاص قيد المحاكمة إمكانية استجواب شهود الادعاء بأنفسهم أو من قبل طرف آخر، وضمان حضور شهود الدفاع واستجوابهم في ظروف مماثلة؛

80. States resorting to military or specialized courts or tribunals in countering terrorism are called upon to accord due attention to the basic standards of fair trial and to the right of equality before the courts in order to ensure a proper administration of justice and respect for the rule of law.
80 - ويطلب إلى الدول التي تلجأ إلى المحاكم العسكرية أو المتخصصة في سياق مكافحة الإرهاب إلى أن تولي الاهتمام الواجب للمعايير الأساسية المتمثلة في المحاكمة العادلة والحق في المساواة أمام المحاكم ضماناً لإقامة العدل على نحو سليم واحترام سيادة القانون.

6. Calls upon States to ensure that the principles of equality before the courts and before the law are respected within their judicial systems by, inter alia, providing to those being tried the possibility to examine, or to have examined, the witnesses against them and to obtain the attendance and examination of witnesses on their behalf under the same conditions as witnesses against them;
6- يدعو الدول إلى أن تضمن في نظمها القانونية مبدأ المساواة أمام المحاكم وأمام القانون وذلك بوسائل منها منح الأشخاص قيد المحاكمة إمكانية استجواب شهود الادعاء بأنفسهم أو من قبل طرف آخر، وضمان حضور شهود النفي واستجوابهم في ظروف مماثلة؛

The Committee observes that the notion of equality before the courts and tribunals encompasses the very access to the courts, and that a situation in which an individual's attempts to seize the competent jurisdictions of his/her grievances are systematically frustrated runs counter to the guarantees of article 14, paragraph 1.
وتلاحظ اللجنة أن مفهوم المساواة أمام القضاء والمحاكم يشمل إتاحة سبل الوصول الى المحاكم، وأن الوضع الذي يتم فيه بشكل منتظم إحباط محاولات أي فرد عرض شكاواه على السلطات القضائية المختصة يناقض الضمانات الواردة في الفقرة ١ من المادة ٤١.
