It was therefore suggested that a better way to proceed would be to consider the amended Model Law on an article-by-article basis, while giving particular attention to the question of the number of methods of procurement in the context of the discussion on article 16.
ولذلك رئي أن الطريقة اﻷفضل هي النظر في القانون النموذجي المعدل مادة مادة، مع إيلاء اعتبار خاص، في الوقت ذاته، لمسألة عدد أساليب الاشتراء في سياق مناقشة المادة ١٦.

It was stated that the footnote dealt with the question of choice of methods of procurement in a very general manner and might lead to uncertainty with regard to choice of procurement methods in the already existing Model Law on Procurement of Goods and Construction, which did not contain a footnote in this regard, although the Guide to Enactment of that Law did refer to options.
وقال البعض إن الحاشية تتناول مسألة اختيار أساليب الاشتراء بطريقة عامة جدا مما قد يؤدي الى عدم اليقين فيما يتعلق باختيار أساليب الاشتراء في القانون النموذجي القائم فعلا الخاص باشتراء السلع والانشاءات ولا يتضمن حاشية بهذا المعنى، وإن يكن دليل تشريع ذلك القانون يشير الى وجود خيارات.

In that regard, it was pointed out that the Model Law did not, as such, contain an excessive number of methods of procurement since, as explained in the Guide to Enactment (A/CN.9/393, para. 16), the three methods set forth in article 17 were optional and an enacting State might wish not to enact all of them in its law.
وفي ذلك الصدد، أوضح البعض أن القانون النموذجي بحد ذاته لا يتضمن عددا مفرطا من أساليب الاشتراء ﻷن اﻷساليب الثلاثة المبينة في المادة ١٧، كما هو موضح في الدليل التشريعي A/CN.9/393) ، الفقرة ١٦(، إنما هي أساليب اختيارية وقد لا ترغب الدولة المشرعة في أن تدرجها كلها في قانونها.
