وأعربت معظم الوفود عن تفضيلها للنهج المتبع في مشروع اللجنة البحرية الدولية الذي يقتضي تطبيق جميع أحكام الاتفاقية على السفن التابعة لدول غير متعاقدة.

29. It was noted that article 8 (2) of the 1952 Convention had given rise to problems of interpretation in various jurisdictions. The wording of article 8 (2) did not make it clear whether the whole of the provisions of the Convention were to apply to ships of non-contracting States, or only article 1 providing for right of arrest in respect of maritime claims.
٩٢- لوحظ ان المادة ٨)٢( من اتفاقية عام ٢٥٩١ قد أثارت مشاكل تتعلق بتفسيرها في مختلف الولايات القضائية، فصيغتها لا توضح ما اذا كانت جميع احكام الاتفاقية واجبة التطبيق على السفن التابعة لدول غير متعاقدة أو ما إذا كانت المادة ١ التي تنص على حق الحجز فيما يتعلق بالمطالبات البحرية هي وحدها التي تنطبق.

35. Thus, under paragraph 2 of Article 8, ships flying the flag of non-contracting States may be arrested not only in respect of maritime claims listed in Article 1, but also for any claim provided such arrest is permitted under lex fori.
٥٣- وهكذا يجوز، بموجب الفقرة ٢ من المادة ٨، حجز السفن التي ترفع علم دولة غير متعاقدة ليس فقط فيما يتعلق بالمطالبات البحرية المدرجة في المادة ١، ولكن أيضا فيما يتعلق بأية مطالبة أخرى شريطة أن يكون هذا الحجز مسموحا به بموجب قانون المحكمة.
