C. Replacement of the phrase " illicitly acquired assets " with the phrase " proceeds of offences established in accordance with this Convention "

1. This Convention shall apply, in accordance with its terms, to the prevention, investigation and prosecution of corruption and to the freezing, seizure, confiscation and return of the proceeds of offences established in accordance with this Convention.
1- تنطبق هذه الاتفاقية، وفقا لأحكامها، على منع الفساد والتحري عنه وملاحقــة مرتكبيه، وعلى تجميد وحجز وارجاع العائدات المتأتية من الأفعال المجرّمة وفقا لهذه الاتفاقية.

(e) Preventing and combating the transfer of proceeds of offences established in accordance with this Convention and recovering such proceeds;
(ﻫ) منع ومكافحة إحالة عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية وارجاع تلك العائدات؛

(f) Detecting and freezing of the transfer of proceeds of offences established in accordance with this Convention;
(و) كشف وتجميد احالة عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية؛

10. States Parties shall endeavour to promote the reintegration into society of persons convicted of offences established in accordance with this Convention.
10- تسعى الدول الأطراف إلى تشجيع إعادة إدماج الأشخاص المدانين بارتكاب أفعال مجرّمة وفقا لهذه الاتفاقية في مجتمعاتهم.

(h) Appropriate and efficient legal and administrative mechanisms and methods for facilitating the return of proceeds of offences established in accordance with this Convention;
(ح) استحداث آليات وأساليب قانونية وإدارية ملائمة وفعّالة لتيسير إرجاع عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية؛

4. In the case of offences established in accordance with this Convention, each State Party shall take appropriate measures, in accordance with its domestic law and with due regard to the rights of the defence, to seek to ensure that conditions imposed in connection with decisions on release pending trial or appeal take into consideration the need to ensure the presence of the defendant at subsequent criminal proceedings.
4- في حالة الأفعال المجرّمة وفقا لهذه الاتفاقية، تتخذ كل دولة طرف تدابير مناسبة، وفقا لقانونها الداخلي ومع إيلاء الاعتبار الواجب لحقوق الدفاع، ضمانا لأن تُراعي الشروط المفروضة فيما يتعلق بقرارات الإفراج على ذمة المحاكمة أو الاستئناف ضرورة ضمان حضور المدعى عليه في الإجراءات الجنائية اللاحقة.

4. In the case of offences established in accordance with this Convention, each State Party shall take appropriate measures, in accordance with its domestic law and with due regard to the rights of the defence, to seek to ensure that conditions imposed in connection with decisions on release pending trial or appeal take into consideration the need to ensure the presence of the defendant at subsequent criminal proceedings.
4- في حالة الأفعال المجرّمة وفقا لهذه الاتفاقية، تتخذ كل دولة طرف تدابير مناسبة، وفقا لقانونها الداخلي ومع إيلاء الاعتبار الواجب لحقوق الدفاع، لضمان أن تراعي الشروط المفروضة بخصوص قرارات الإفراج إلى حين المحاكمة أو الاستئناف ضرورة حضور المدعى عليه في الإجراءات الجنائية اللاحقة.

(g) Surveillance of the movement of proceeds of offences established in accordance with this Convention and of the methods used to transfer, conceal or disguise such proceeds;
(ز) مراقبة حركة عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية والأساليب المستخدمة في إحالة تلك العائدات أو إخفائها أو تمويهها؛

Although some members of the consistency group initially suggested replacing the entire phrase with the words " proceeds of crime established in accordance with this Convention " , the consensus was that the phrase " proceeds of offences established in accordance with this Convention " would be the most appropriate, in that it would ensure consistency and avoid tautology.
ومع أن بعض أعضاء فريق الاتساق اقترحوا في البداية تبديل هذه العبارة بعبارة " عائدات الجرائم المقررة وفقا لهذه الاتفاقية " ، فقد توافقت الآراء على أن عبارة " عائدات الأفعال المجرّمة وفقا لهذه الاتفاقية " هي العبارة الأنسب، إذ تكفل الاتساق وتتفادى الحشو.

Each State Party shall ensure that, in the case of domestic criminal investigations of offences established in accordance with this Convention, there are appropriate mechanisms available within its domestic legal system to overcome obstacles that may arise out of the application of bank secrecy laws.
تكفل كل دولة طرف، في حال القيام بتحقيقات جنائية داخلية في أفعال مجرّمة وفقا لهذه الاتفاقية، وجود آليات مناسبة في نظامها القانوني الداخلي لتذليل العقبات التي قد تنشأ عن تطبيق قوانين السرية المصرفية.

Each State Party shall also consider taking such measures as may be necessary to permit its competent authorities to share that information with the competent authorities in other States Parties when necessary to investigate, claim and recover proceeds of offences established in accordance with this Convention.
وتنظر كل دولة طرف أيضا في اتخاذ ما قد يلزم من تدابير للسماح لسلطاتها المختصة بتقاسم تلك المعلومات مع السلطات المختصة في الدول الأطراف الأخرى، عندما يكون ذلك ضروريا للتحقيق في العائدات المتأتية من أفعال مجرّمة وفقا لهذه الاتفاقية والمطالبة بها واستردادها.
