6 - إذا جادلت الدولة الطرف فيما يدعيه مقدم أو مقدمو الرسالة، وفقا للمادة 4-1 من البروتوكول الاختياري، من استنفاد جميع سبل الانتصاف المحلية المتاحة، تعرض تلك الدولة تفاصيل أشكال الانتصاف المتاحة للضحية المزعومة أو الضحايا المزعومين في الملابسات المحددة للقضية.

Under article 19 of the Act, the following actions are permitted without the consent of the author or copyright owner and without payment of royalties, provided the name of the author whose work is being used is cited and the source of the information in question is stated:

Article 2,166 provides that: “For the purposes of the previous article, the author of a literary, scientific or artistic work is deemed to be the person who creates it, or that person's heirs universal or particular, regardless of whether the work is published under the name of the author or under a pseudonym.
165- وتنص المادة 2166 على ما يلي: " لأغراض المادة السابقة، يُعتبر مؤلف العمل الأدبي أو العلمي أو الفني هو الشخص الذي يُبدعه، أو ورثة ذلك الشخص العامون أو الخاصون، بغض النظر عما إذا كان العمل نُشر باسم المؤلف أو باسم مستعار.

(i) Broadcasting organizations may, without the authority of the author or payment of special remuneration, make ephemeral recordings of a work that they have the right to broadcast, using their own equipment and for use in their own broadcasts.
(ط) يجوز لمنظمات البث الإذاعي أو التلفزيوني، دون إذن من المؤلف أو دفع رسم خاص، إجراء تسجيلات سريعة الزوال لعمل يحق لها بثه، مستخدمةً معداتها الخاصة ومن أجل استخدام تلك التسجيلات في برامجها الخاصة.

The State party is also under an obligation to improve the present conditions of detention of the author, or to release him.
كما أن الدولة الطرف ملزمة بتحسين الأوضاع الحالية لاحتجاز صاحب البلاغ أو إخلاء سبيله.

The State party submits that the courts in question, at no stage of the proceedings, assign any importance to the citizenship of the author or her husband, and thus acted in no way arbitrarily or discriminatorily.
وتدعي الدولة الطرف أن المحاكم المعنية، لم تهتم، في أي مرحلة من مراحل الإجراءات، بموضوع جنسية صاحبة البلاغ أو جنسية زوجها، وبالتالي فإنها لم تتصرف بأي شكل من الأشكال بشكل تعسفي أو تمييزي.
