47. The Working Group considers that the non-observance of the international norms relating to the right to a fair trial, established in the Universal Declaration of Human Rights and the International Covenant on Civil and political Rights in this case is of such gravity as to give the deprivation of liberty an arbitrary character.
ويرى الفريق العامل أن عدم التقيد بالقواعد الدولية المتعلقة بالمحاكمة العادلة، المنصوص عليها في الإعلان العالمي لحقوق الإنسان والعهد الدولي الخاص بالحقوق المدنية والسياسية، من الخطورة بحيث يضفي على الحرمان من الحرية طابعاً تعسفياً.

In the light of the foregoing, the source considers that the non-observance of the international norms relating to the right to a fair trial, as spelled out in the Universal Declaration on Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to render Mr. Rajab's deprivation of liberty arbitrary.

25. The Working Group will not consider proven the allegation that the detention is arbitrary owing to the serious total or partial non-observance of the international norms relating to the right to a fair trial, as established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the State concerned.
25- ولن يعتبر الفريق العامل أن ادعاء الاحتجاز التعسفي مُثبت بجسامة عدم التقيّد، كلياً أو جزئياً، بالقواعد الدولية المتعلقة بالحق في محاكمة عادلة، المقررة في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبِلتها الدولة المعنية.

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial, established in the Universal Declaration of Human Rights and in the relevant international instruments accepted by the States concerned, is of such gravity as to give the deprivation of liberty an arbitrary character (category III);

However, the effective implementation of the international norms at the national level is uneven.
بيد أن تنفيذ القواعد الدولية على الصعيد الوطني تنفيذاً فعالاً هو أمر متباين.

(c) When the total or partial non-observance of the international norms relating to the right to a fair trial established in the Universal Declaration of Human Rights and in the relevant international instruments that have been accepted by the States concerned is of such gravity as to give the deprivation of liberty an arbitrary character (category III);
(ج) إذا كان عدم التقيد كلياً أو جزئياً بالقواعد الدولية المتصلة بالحق في محاكمة عادلة، وهي القواعد المنصوص عليها في الإعلان العالمي لحقوق الإنسان وفي الصكوك الدولية ذات الصلة التي قبلتها الدولة المعنية، من الخطورة بحيث يصير سلب الحرية تعسفياً (الفئة الثالثة)؛

32. The Working Group considers that the non-observance of the international norms relating to the right to a fair trial in this case, namely article 10 of the Universal Declaration of Human Rights and article 14, paragraph 3 (b), (d) and (e), of the International Covenant on Civil and Political Rights, is of such gravity as to give the deprivation of liberty of Mr. Abedini an arbitrary character.
32- ويرى الفريق العامل أن عدم التقيد بالقواعد الدولية المتصلة بالحق في محاكمة عادلة في هذه القضية، ولا سيما المادة 10 من الإعلان العالمي لحقوق الإنسان والفقرة 3(ب) و(د) و(ﻫ) من المادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية، من الخطورة بحيث يصير سلب حرية السيد عابديني تعسفياً.

Its reference to the maintenance of the death penalty as an effective measure to combat serious crimes formed part of the international norms agreed to by all Member States.
وإشارته إلى الاحتفاظ بعقوبة الإعدام بوصفه تدبيرا فعليا لمكافحة الجرائم الخطيرة تشكل جزءا من القواعد الدولية التي توافق عليها جميع الدول الأعضاء.

It is submitted that the non-observance of the international norms relating to the right to a fair trial is so grave that it renders Mr. Jama's detention an arbitrary character.
وأشار المصدر إلى أن عدم التقيد بالمعايير الدولية المتعلِّقة بالحق في محاكمة عادلة بلغ حداً من الخطورة يجعل احتجاز السيد جامع تعسفياً.

I should like to underline that responsibility and solidarity are also basic pillars of the international norms in that regard.
وأود أن أؤكد أن المسؤولية والتضامن أيضا ركنان أساسيان للقواعد الدولية في ذلك الصدد.
