If within thirty days of the request for arbitration either Party has not appointed an arbitrator or if within thirty days of the appointment of two arbitrators the third arbitrator has not been appointed, either Party may request the President of the International Court of Justice to appoint an arbitrator.
وإذا انقضى ثلاثون يوماً على طلب التحكيم دون أن يعيِّن أي من الطرفين محكِّماً، أو إذا لم يتم تعيين المحكِّم الثالث خلال ثلاثين يوماً من تعيين المحكِّمَين، يجوز لأي من الطرفين أن يطلب إلى رئيس محكمة العدل الدولية تعيين محكِّم.

If, six months after the date of the request for arbitration, those States Parties are unable to agree on the organization of the arbitration, any one of those Parties may refer the dispute to the International Court of Justice by request in conformity with the Statute of the Court.
واذا لم تستطع تلك الدول اﻷطراف ، بعد ستة أشهر من تاريخ طلب التحكيم ، الاتفاق على تنظيم التحكيم ، جاز ﻷي طرف من تلك اﻷطراف أن يحيل النزاع الى محكمة العدل الدولية بطلب يتوافق مع النظام اﻷساسي للمحكمة .
