The Requested Party shall take necessary measures to permit the owner or the owner's authorized representative to take delivery of the vehicle and return it to the territory of the requesting Party.

5. Before denying a request, the Central Authority or the Executing Authority of the Requested Party, as appropriate, shall consult with the Central Authority of the requesting Party and the Antitrust Authority that made the request to determine whether assistance may be given in whole or in part, subject to specified terms and conditions.
5- قبل رفض أي طلب، تتشاور الهيئة المركزية أو الهيئة المنفذة التابعة للطرف المتلقي للطلب، حسب الحالة، مع الهيئة المركزية للطرف المقدِّم للطلب ومع الهيئة المعنية بمكافحة الاحتكار المقدِّمة للطلب لتحديد ما إذا كان بالإمكان تقديم المساعدة كلياً أو جزئياً، رهناً بمراعاة أحكام وشروط محددة؛

٨ - يجوز للدولة الطرف متلقية الطلب ، رهنا بأحكام قانونها الداخلي وما ترتبط به من معاهدات لتسليم المجرمين ، وبناء على طلب من الطرف الطالب ، أن تحتجز الشخص المطلوب تسليمه والموجود في اقليمها ، أو أن تتخذ تدابير مناسبة أخرى لضمان حضوره اجراءات التسليم ، متى اقتنعت بأن الظروف تسوغ التسليم وبأنها ملحة .

13. If extradition, sought for purposes of enforcing a sentence, is refused because the person sought is a national of the requested State Party, the requested Party shall, if its law so permits and in conformity with the requirements of such law, upon application of the requesting Party, consider the enforcement of the sentence that has been imposed under the law of the requesting Party, or the remainder thereof.
٣١ - اذا رفض طلب التسليم الرامي الى تنفيذ عقوبة ما ﻷن الشخص المطلوب تسليمه من مواطني الدولة الطرف متلقية الطلب ، على الطرف متلقي الطلب أن ينظر ، اذا كان قانونه يسمح بذلك وطبقا لمقتضيات هذا القانون ، وبناء على طلب من الطرف الطالب ، في تنفيذ العقوبة المحكوم بها بموجب قانون الطرف الطالب ، أو ما تبقى من هذه العقوبة .

10. If extradition, sought for purposes of enforcing a sentence, is refused because the person sought is a national of the requested State Party, the requested Party shall, if its law so permits and if it is in conformity with the requirement of such law, upon application of the requesting Party, consider the enforcement of the sentence that has been imposed under the law of the requesting Party or the remainder thereof.
٠١ - اذا رفض طلب تسليم ، مقدم بغرض تنفيذ حكم قضائي ، بحجة أن الشخص المطلوب تسليمه من مواطني الدولة الطرف متلقية الطلب ، وجب على الطرف متلقي الطلب ، اذا كان قانونه يسمح بذلك واذا كان ذلك يتفق ومقتضيات ذلك القانون ، وبناء على طلب من الطرف الطالب ، أن ينظر في تنفيذ الحكم الصادر بمقتضى قانون الطرف الطالب ، أو ما تبقى من العقوبة المحكوم بها .

3. If the Requested Party determines that the request for return does not meet the requirements of the present Treaty, it shall provide written notification to [the Embassy] of the requesting Party.
٣ - إذا قرر الطرف الموجه إليه الطلب أن طلب الاعادة لا يفي بشروط هذه المعاهدة، فانه يرسل اخطارا مكتوبا بذلك إلى ]سفارة[ الطرف مقدم الطلب.

1. Except as provided for in article 8 below, the Requested Party shall, within [thirty] days of receiving a request for the return of a stolen or embezzled vehicle, determine whether the request for return meets the requirements of the present Treaty and shall notify [the Embassy] of the requesting Party of its determination.
١ - باستثناء ما تنص عليه المادة ٨ أدناه، يبت الطرف الموجه إليه الطلب، في غضون ]ثلاثين[ يوما من تلقيه طلب إعادة مركبة مسروقة أو مختلسة، فيما إذا كان طلب الاعادة مستوفيا شروط هذه المعاهدة، ويخطر ]سفارة[ الطرف مقدم الطلب بقراره هذا.

With regard to the relationship with the countries that are signatories to the European Convention on Extradition of 13 December 1957, it is pointed out that extradition shall be granted in respect of offences that are punishable, under the laws of the requesting Party and those of the requested Party, by deprivation of liberty or detention order for a period of at least one year or by a more severe penalty.
وفيما يخص العلاقة مع البلدان الموقعة على الاتفاقية الأوروبية لتسليم المجرمين المؤرخة 13 كانون الأول/ديسمبر 1957، فإن إسبانيا تسلم إلى تلك البلدان من يرتكب أفعالا تعاقب عليها قوانين الطرف المطالب بتسليمهم وقوانين الطرف المطلوب منه تسليمهم بعقوبة السجن أو الاحتجاز لمدة لا تقل عن عام أو بعقوبة أشد.

6. If a request is denied in whole or in part, the Central Authority or the Executing Authority of the Requested Party, as appropriate, shall promptly inform the Central Authority of the requesting Party and the Antitrust Authority that made the request and provide an explanation of the basis for denial.
6- إذا رُفض الطلب كلياً أو جزئياً، يجب على الهيئة المركزية أو الهيئة المنفذة التابعة للطرف المتلقي للطلب، حسب الحالة، أن تبلغ الهيئة المركزية للطرف المقدِّم للطلب والهيئة المعنية بمكافحة الاحتكار المقدِّمة للطلب على وجه السرعة وأن تقدم شرحاً يبين أسباب هذا الرفض.

If that proposal was not acceptable and if it was the consensus to accept the ICC variant, an explanatory note should be included, giving the Working Group's precise views on the scope of the requesting Party's duty to disclose all material circumstances.
وإذا لم يحظ هذا الاقتراح بالقبول وكان هناك توافق آراء بشأن قبول الصيغة التي تقدَّمت بها غرفة التجارة الدولية، فينبغي إضافة ملاحظة إيضاحية تبيِّن بصورة دقيقة آراء الفريق العامل بشأن نطاق واجب الكشف عن جميع الظروف الجوهرية الواقع على الطرف الطالب.
