(35) The Committee is concerned about the case of Muhannad Al-Hassani, president of the Syrian Human Rights Organization (Swasiah), arrested on 28 July 2009 and charged with " weakening national sentiment " and " spreading false or exaggerated information " in connection with his monitoring of the Supreme State Security Court.
(35) وتشعر اللجنة بالقلق إزاء حالة مهنّد الحسني رئيس المنظمة السورية لحقوق الإنسان (سواسية) الذي قبض عليه في 28 تموز/يوليه 2009 واتهم بإضعاف الشعور القومي ونشر معلومات كاذبة أو مبالغ فيها فيما يتصل بمحكمة أمن الدولة العليا.

The State party should take urgent measures to ensure that all rights and guarantees provided under article 14 of the Covenant are respected in the composition, functions and procedures of the Supreme State Security Court and in particular that accused persons are granted the right to appeal against decisions of the Court.

11- تلاحظ اللجنة المعلومات التي قدمتها إليها الدولة الطرف بشأن تشكيلة محكمة أمن الدولة العليا ووظائفها وإجراءاتها، لكنها تشعر بقلق بالغ إزاء الادعاءات الكثيرة والدائمة والخطيرة التي تفيد أن هذه المحكمة لا تعمل وفقاً للمعايير الدولية للمحاكم القانونية.

In support of his claim, he presented a copy of the judgment of the Supreme State Security Court, as well as a forensic medical report dated 7 September 2004 (examination on 26 August 2004) and a psychiatric report dated 15 September 2004 (examination on 25 August 2004), issued by experts of the Centre for Treatment of Crisis and Trauma Victims in Stockholm.

In its concluding observations, following its consideration of the second periodic report submitted by the Syrian Arab Republic under article 40 of the International Covenant on Civil and Political Rights (CCPR/CO/71/SYR), the Human Rights Committee declares that the procedures of the Supreme State Security Court are incompatible with the provisions of article 14, paragraphs 1, 3 and 5, of the Covenant.
وبعد النظر في التقرير الدوري الثاني الذي قدمته الجمهورية العربية السورية وفقاً للمادة 40 من العهد الدولي الخاص بالحقوق المدنية والسياسية (CCPR/CO/71/SYR)، تعلن اللجنة المعنية بحقوق الإنسان في ملاحظاتها الختامية، أن إجراءات محكمة أمن الدولة العليا لا تتفق مع أحكام الفقرات 1 و3 و5 من المادة 14 من العهد.
