According to general comment No. 20 of the Human Rights Committee, to which an express reference would be appropriate, States must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

It recalls that States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by virtue of their extradition, expulsion or refoulement.

116. In case No. 1315/2004 (Singh v. Canada), the Committee recalled that States parties had the obligation not to expose individuals to a real risk of being killed or subjected to torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

14.2 As to whether the author's extradition to Kyrgyzstan exposed him to a real risk of torture or ill-treatment, the Committee observes that States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

In this regard, the Committee reiterates that States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

According to the Special Rapporteur, the detention of the three persons in question from April 1994 for the purpose of their extradition could not exceed three months, in conformity with the Extradition Treaty signed by Zaire and Burundi on 21 June 1975. They should thus have been released in July 1994 at the latest.
وكما يؤكد هذا التقرير فإن احتجاز هؤلاء اﻷشخاص الثلاثة ابتداء من شهر نيسان/أبريل ٤٩٩١ انتظاراً لتسليمهم لا يجوز أن يتجاوز ثلاثة أشهر وفقا لاتفاقية تسليم المجرمين المعقودة بين زائير وبوروندي في ١٢ حزيران/يونيه ٥٧٩١، لذا كان من الواجب اطلاق سراحهم في شهر تموز/يوليه ٤٩٩١ على أكثر تقدير.

For example, at the universal level, general comment No. 20 of the Human Rights Committee indicated that " States parties must not expose individuals to the danger of torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement " .
