Some delegations noted that, even though article 4 of Annex II to the Convention establishes that a coastal State shall make a submission as soon as possible but in any case within 10 years of the entry into force of the Convention for that State, in accordance with article 77 of the Convention, the rights of the coastal State over the continental shelf do not depend on occupation, effective or notional, or on any express proclamation.

Moreover, I would like yet again to recall that the work of the Commission has to do with the demarcation of the limit already established in article 76 of the Convention, not with the rights of the coastal State, and that article 77, paragraph 3, of the Convention provides that " The rights of the coastal State over the continental shelf do not depend on occupation, effective or notional, or on any express proclamation " .
