6. First, a written request for clarification must be made to the supplier or contractor concerned seeking details of constituent elements of the submission presented that the procuring entity considers relevant to justify the price submitted.

2. Any decision of the procuring entity to exclude a supplier or contractor from the procurement proceedings under this article and the reasons therefor shall be included in the record of the procurement proceedings and promptly communicated to the supplier or contractor concerned.
2- يُدرَجُ أيُّ قرار تتَّخذه الجهةُ المشترية باستبعاد المورِّد أو المقاول من إجراءات الاشتراء بمقتضى هذه المادة، وأسبابُ ذلك الاستبعاد، في سجل إجراءات الاشتراء، ويُسَارَع إلى إبلاغه إلى المورِّد أو المقاول المعني.

(a) The procuring entity and the supplier or contractor concerned shall sign the procurement contract within a reasonable period of time after the notice of acceptance is dispatched to the supplier or contractor concerned;
(أ) تقوم الجهةُ المشترية والمورِّد أو المقاول المعني بالتوقيع على عقد الاشتراء في غضون مدة معقولة بعد إرسال الإشعار بالقبول إلى المورِّد أو المقاول المعني؛

(b) Unless the solicitation documents stipulate that the procurement contract is subject to approval by another authority, the procurement contract enters into force when the contract is signed by the supplier or contractor concerned and by the procuring entity.
(ب) يبدأ نفاذُ عقد الاشتراء عندما يوقِّع المورِّد أو المقاول المعني والجهة المشترية على العقد، ما لم تنص وثائق الالتماس على أن يكون عقد الاشتراء خاضعاً لموافقة سلطة أخرى.

(2) The decision of the procuring entity to reject a submission in accordance with this article and reasons for the decision shall be included in the record of the procurement proceedings and promptly communicated to the supplier or contractor concerned.
(2) يُدرج قرار الجهة المشترية برفض أيِّ عرض مقدَّم، وذلك بمقتضى هذه المادة، وأسباب ذلك القرار، في سجل إجراءات الاشتراء، ويُسَارع إلى إبلاغه إلى المورِّد أو المقاول المعني.

(a) The procuring entity and the supplier or contractor concerned shall sign the procurement contract within a reasonable period of time after the notice of acceptance is dispatched to the supplier or contractor concerned;

(ب) يبدأ نفاذ عقد الاشتراء عندما يوقِّع المورِّد أو المقاول المعني والجهة المشترية على العقد، ما لم تنص وثائق الالتماس على أن يكون عقد الاشتراء خاضعا لموافقة سلطة أخرى.

5. Accordingly, subparagraphs 1 (a) to (c) of the article specify the steps that the procuring entity has to take before the abnormally low submission may be rejected, to ensure due process is followed and to ensure that the rights of the supplier or contractor concerned are preserved.

(d) Appeals against a decision of the procuring entity [or approving authority] made under article [62 (3)] of this Law shall be submitted within ... working days (the enacting State specifies the period) after the decision was communicated to the supplier or contractor concerned.
(د) تُقدَّم طلبات استئناف أيِّ قرار تتخذه الجهة المشترية [أو السلطة المعنية بإصدار الموافقة] بمقتضى المادة [62 (3)] من هذا القانون في غضون ... يوم عمل (تحدد الدولة المشترعة هنا المدة الزمنية) بعد تبليغ القرار إلى المورِّد أو المقاول المعني.

In connection with that amendment, the point was made that, in order to preserve the anonymity of bidders, the results of the full evaluation of initial bids should be communicated individually and simultaneously to each supplier or contractor concerned, but in order not to prejudice the legitimate commercial interests of the parties or to inhibit subsequent fair competition, only to the extent relevant to each such supplier or contractor.
