97. In their replies, many States indicated that acts of racial discrimination and/or incitement to such acts were prohibited by law.

103. While legislative measures are necessary in order to prohibit and sanction the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as acts of violence or incitement to such acts against a specific group of persons, the Special Rapporteur is of the view that legislative measures on their own are usually insufficient to effectively prevent and combat the aforementioned phenomena.

106. As mentioned by some States in their replies summarized above, the existence of accessible and effective remedies is an absolute necessity to deter and fight the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as acts of violence or incitement to such acts against a specific group of persons.
106 - وعلى نحو ما أشارت إليه بعض الدول في ردودها الموجزة أعلاه، فإن وجود وسائل انتصاف فعالة وفي متناول اليد أمر بالغ الأهمية لمنع ومكافحة نشر الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية والتحريض على التمييز العنصري، وكذلك لمنع ومكافحة أعمال العنف أو التحريض على ارتكابها ضد مجموعة معينة من الأشخاص.

He recalls that any advocacy of national, racial or religious hatred which constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.

476. With regard to non-political groups and associations which disseminate ideas based on racial superiority or hatred or incitement to racial discrimination, as well as acts of violence or incitement to such acts against any race or group of persons, the Committee recommends that the State party take all measures required under the Convention to prohibit their existence.

Notes that article 4 (b) of the International Convention on the Elimination of All Forms of Racial Discrimination places an obligation upon States to be vigilant and to proceed against organizations that disseminate ideas based on racial superiority or hatred, acts of violence or incitement to such acts; those organizations shall be condemned and discouraged;
