However, the claims presented in this instalment raise the issue of the compensability of losses incurred outside Kuwait or Iraq on a much broader scale.

Accordingly, the Panel finds that losses or expenses that meet the criteria set forth in paragraph 35 of Governing Council decision 7 are compensable in principle, even if they occurred outside Kuwait or Iraq.

In these circumstances, the Panel agrees with the holding of the “C” Panel, that “a claim based on an incident occurring outside Kuwait or Iraq needs to be more fully substantiated” in order to establish the necessary causal link between the loss and the invasion and occupation of Kuwait.

Moreover, the decisions of the Governing Council do not limit the Commission's jurisdiction in terms of the place where the direct loss or damage was suffered. / The Panel finds that there is no jurisdictional limitation, in principle, to the award of compensation for losses sustained outside Kuwait or Iraq. /

In the same discussion, the “F1 " Panel agreed with the “C” Panel’s finding that “a claim based on an incident occurring outside Kuwait or Iraq needs to be more fully substantiated” to establish the necessary direct link between the loss and Iraq’s unlawful invasion and occupation of Kuwait.

The Panel considers that, given the nature of the Claims, the facts supporting many of the losses allegedly sustained outside Kuwait or Iraq are such that, in order for them to meet the requirement of directness, it must be demonstrated that they fall within the ambit of paragraph 34(a) of Governing Council decision 7, which provides as follows:
