ونصت المادة 26 على أن " الولي في الزواج هو الأب، فالجد العاصب، فالابن، فالأخ الشقيق ثم للأب، فالعم الشقيق ثم لأب.

- مات شخص عن بنت وأخت شقيقة، وترك أخاً لأب، وابن أخ شقيق وابن أخ لأب وعماً وابن عم، فإن الأخت الشقيقة مع البنت عصبة مع الغير في قوة الأخ الشقيق، تحجب ما يحجبه الأخ الشقيق، فتحجب كل هؤلاء الرّجال، وهكذا ترث البنت النصف فرضاً وترث الأخت الشقيقة النصف فرضاً ولا يرث الأخ لأب ولا أبناء الأخوة ولا الأعمام ولا أبناء الأعمام، وكلّهم ذكور (18).
