Any person accused of a penal offence must be brought before a judicial authority, be informed of the reasons for his arrest and must be shown an arrest warrant.

4.6 The State party further argues that the Convention against Torture does not impose upon any one State the exclusive or even preferential competence to try a person accused of torture, in the instant case, an exclusive or preferential competence of Spain to try a Chilean citizen for crimes committed in Chile.

Moreover, in paragraph 6 (c), the Council urges States to " ensure that no statement established to have been made as a result of torture is invoked as evidence in any proceedings, except against a person accused of torture as evidence that the statement was made " .

30. This imbalance, taking into account the severe sentences received by the persons under consideration in this case, is incompatible with the standards contained in article 14 of the International Covenant on Civil and Political Rights which guarantee that each person accused of a crime has the right, in full equality, to all the facilities adequately to prepare his/her defence.
30- وعدم التوازن هذا، باعتبار الحكم المشدد الصادر بحق الأشخاص المذكورين في هذه القضية، لا يتفق مع المعايير المنصوص عليها في المادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية التي تنص على أن لكل فرد متهم في جريمة الحق، مع المساواة الكاملة، في جميع التسهيلات المناسبة لإعداد دفاعه.

Paragraph 4 stipulates that the State Party must exercise its jurisdiction in order to prosecute a person accused of committing the offence, if it is not willing to extradite him to a State which so requests.
